JOSEPH COUNTY ( SS <br />In the hatter of Condemnation <br />2is elut ion No. 52 ; f or the <br />opening of Huron Street from ) <br />alley west of Harms Street -to ) <br />-allay east of Rosc iusake St. ° ) <br />$*for* the Honorable Beard Of <br />''Public Works of the City of South <br />Bead, said County, and State. <br />Remonstrance of New Jersey, <br />Indiana -, Illinois Railroad <br />Company. <br />Now comes the New Jersey, Ildiana & Illinois Railroad Company <br />a corporation duly orZaA zed and existing under and by virtue of the laws of the <br />State of Indiana, and. remonstrate* and objects to the appropr iat ion of the real <br />estate as in said Condemnation Resolution No. 5 set forth and sought to be <br />appropriated, and for grounds of remonstrance and objections thi4 remonstrant says; <br />That it is the owner in fee -of the following described real estate situated in. the <br />City of South Bend, said County and State; <br />Beginning at the intersection of the north line of <br />Huron Street extended West and a West line of the first <br />Alley west of Huron Staoet; the * nortbwosterly to a <br />point on the east -line of he first alley east of ' <br />Kosc iuszko Street soveu (7) fee east of the southeast <br />° corner of lot_ 17 in J. M. tude ker's Sub -Division <br />of lot #1 of Harper., ruc eats Survey;• thence south <br />sixty (60) feet; thence southeasterly to a po inton the <br />south line of Huron Street extended west, which point <br />is seven (7) feet west Of the northwest corner of lot <br />23 in Harris Second Sub -Division of Bank Out Lot #97 <br />thence north fifty (50) felt to the place of beginning, <br />That said above described r al-, estate is the real estate described <br />in and sought to be condemned and apprpr sated by said Condemnation Res olut ion No52 <br />as aforesaid. <br />Your remonstrant further says that there is no public necessity <br />or demand or need for the appropriation of said real. estate for street purposes or for <br />the establishment of a.street through sand seal estate at that point; that the <br />Opening of a street through said real estate, as provided for in said resolution, <br />would net be a public utility; that said lead sought to be appropriated is not <br />necessary for street purposes; that under all the circumstances the expense incurred <br />in appropriating said real estate would bed out of proportion to_ the benefits received <br />therefrom. - . <br />For further grounds of rem <br />the opening of Huron Street, as contemplated by <br />because the said Huron Street has a dead end tw <br />Factory.
