Area Board of Zoning Appeals—January 4, 2012 <br /> ALIBABA CAFE LLC <br /> The petition ofAlibaba Caf6 LLC seeking a Special Exception to allow a billiard hall in a"LB"District and <br /> from the following variances: from the required 22 parking spaces to 17; from the required 30' front yard <br /> setback to 14', from the required 30' side front yard to 23', to allow parking within the required residential <br /> buffer yard, from the required 15' setback for parking on Terrace Lane to S', from the required residential <br /> buffer yard on the north and west to 0', and from the required foundation landscaping to none on existing <br /> building on property located at 17917 State Road 23, Clay Township. Zoned Business and Residential <br /> pending rezoning to "LB"and annexation. <br /> MR. RANDALL MYERS: Architect with Interface Architecture and Design located at 57190 Alpha Drive <br /> in Goshen. I represent the petitioner. The petitioner proposes to renovate a vacant building located at the <br /> corner of State Road 23 and Terrace Lane, that would be the northeast comer, to a billiard hall to offer light <br /> recreation in the form of pool and beverage serving and conversation. They propose to add a covered patio <br /> for the purposes of creating a differentiated atmosphere understanding that inside the building and the pool <br /> hall there will much more noise than could be accommodated outside. And I would point out that there is no <br /> alcohol involved here. We're talking light beverages and coffees. We are asking for variances from <br /> setbacks from both Terrace and State Road 23 because the existing building predates the current zoning <br /> setback requirements. We are asking for reduced parking because of the restrictions of the lot. And the <br /> same as to parking in the residential buffer. <br /> MR. HAWLEY: I'm assuming that the existing building is the building that you're going to be using but <br /> kind of updated? <br /> MR. MYERS: Yes, it will be renovated and right now it's an empty building, there are no walls or partitions <br /> in the building. There would be restrooms to accommodate handicap and the rest of the public. There would <br /> be a slight beverage preparation counter. The only actually new construction would be a covered terrace <br /> area which I will point out faces the two streets and is on the opposite side of the building to the residential <br /> properties. <br /> MR. PHIPPS: How many people would you expect might be using this facility considering both the existing <br /> building and the covered patio? <br /> MR. MYERS: I would defer to the petitioner. What do you think David? <br /> MR. DAVID FARHAN: 1316 E. Calvert St., South Bend. <br /> MR. PHIPPS: What you're asking is for a variance to reduce the number of parking which would be <br /> required for a building of this size but you're also proposing that the facility would include both the indoor <br /> use but also outdoor use, it seems to me that this building could with the size such that could be a lot more <br /> 23 <br />
