Dail Set <br />Set Comb Wrenches <br />Plumb Bob <br />Angle Square <br />Duster <br />Chalk Line <br />DEFINITIONS AND TYPES OF CONTRACTORS <br />SIGNATORY EMPLOYER: Any Employer who is bound by the provisions ofthis Agreement as <br />evidenced by his signature on an official Memorandum of Agreement and or Master Agreement. <br />RE E 1,RENCE TO GENDER: The terms such as men, journeymen, he, his, or such, as used in this <br />Agreement are only for the purpose of clarification and shall not be construed to mean either the male or <br />female gender. <br />SECTION 1: A Contractor or Employer is one who, in relation to any Corporation, Company, <br />Partnership, Firm or other business Entity, is a substantial Owner, Partner, Officer, or in a permanent <br />policymaking position. He shall not be allowed to work intermittently as a journeyman for another <br />Employer, while he himself is engaged or recognized as a Contractor or Employer. <br />SECTION 2: No member of the Union under this Agreement has the right to bid or figure any <br />work against any signatory Employer. This does not exclude any Estimator of a signatory Employer <br />from Union membership; this protects signatory Employers from unfair competition. <br />SECTION 3: All new Employers must appear before the Joint Trade Board of the Local Union <br />in whose geographical jurisdiction the Employer's principal place of business is located. The Union <br />may enter into Collective Bargaining Agreements with an out -of -jurisdiction Contractor or Employer, <br />only if, upon the prior written approval of the 1UPAT General President, the Local Union immediately <br />notifies in writing that Local Union in whose jurisdiction the Employer's principal place of business is <br />located that the agreement has been signed and forwards a complete signed copy ofthat agreement, <br />SECTION 4: Journeymen out of work are allowed to take jobs on their own, but all work must <br />be reported to the Business Representative. <br />ARTICLE XXX <br />Bonding <br />SECTION 1: In order to secure payment of wages, fringe benefits and deductions payable under this <br />Agreement and under any other Agreement requiring a similar security arrangement as identified <br />herein which the Employer or Contractor has with a Local Union affiliated with District Council 91, <br />each Employer or Contractor upon becoming a signatory contractor to this Agreement shall in one of <br />the following ways post security with and in the name of District Council 91 of the International Union <br />of Painters and Allied Trades, AFL-CIO and its affiliated Local Unions: <br />A. By means of a surety bond in the sum of twenty-five thousand dollars ($25,000) <br />underwritten by a surety company acceptable to District Council 91. Such a bond shall utilize the form <br />which is attached to this Agreement, unless the Union otheiivise agrees in writing. <br />B. By means of a cash deposit in the sum of twenty-five thousand dollars ($25,000) with a <br />bank or trust company acceptable to District Council 91 provided through an escrow agreement <br />binding such deposit to the payment ofwages, fringe benefits and deductions, and any later payment <br />penalties thereto. The Employer or Contractor so depositing such funds shall be entitled to all interest <br />earned by said deposit. The escrow agreement shall utilize the form which is attached to this <br />Agreement and shall be with the escrow agent selected by District Council 91, unless the Union <br />otherwise agrees in writing. <br />24 <br />
