REGULAR MEETING JUNE 27, 2011 <br /> <br /> <br /> <br />She noted that Article 10 of Chapter 13 has been stricken and that this bill authorized the <br />only restrictions that can be applied against members of the public. She noted that this <br />the new Statute goes into effect July 1, 2011. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />Councilmember Henry Davis stated that he has great concern regarding this bill. He <br />questioned what local governments could do to get this law changed. He stated that he is <br />not in favor of this bill. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this substitute bill as amended. <br />Councilmember Varner seconded the motion which carried by a voice vote of eight (8) <br />ayes and one (1) nay (Councilmember Henry Davis.) <br /> <br />Councilmember White advised that as Chairperson of the Health and Public Safety <br />Committee she would like to work closely and find out how other communities are <br />dealing with this. <br /> <br /> <br />BILL NO. 27-11 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA APPROPRIATING $1,350,000 <br />FROM MAJOR CAPITAL INVESTMENT <br />PROJECTS IN 2011 <br /> <br />Councilmember LaFountain, Chairperson, Personnel & Finance Committee reported that <br />this committee held a Public Hearing on this bill this afternoon and sends it to the full <br />Council with a favorable recommendation. <br /> <br />Councilmember Dieter advised that he has filed his conflict of interest form with the <br />Office of the City Clerk, County Clerk and with the State of Indiana. He also disclosed <br />that he is a 1974 graduate of St. Joseph High School and that after discussion with <br />Council Attorney Kathleen Cekanski-Farrand it was determined that there is no conflict <br />of interest. <br /> <br />Councilmember Kirsits stated that he has filed his conflict of interest form with the <br />Office of the City Clerk, County Clerk and with the State of Indiana. He also disclosed <br />that his is a 1973 graduate of St. Joseph High School and that his two sons are graduates <br />of St. Joseph High School and that that he has a relative who currently works as a <br />secretary for St. Joseph High School. Councilmember Kirsits advised that he had <br />participated in a pledge campaign where he contributed $100 each year for a total of three <br />(3) years to a football fund to be used for upgrading facilities located at the current <br />locations of St. Joseph High School. He stated later an option was given to have said <br />monies returned, or have them remain in the fund and be used for a future project. He <br />stated that those monies remain in the fund at the present time. After discussion with <br />Council Attorney Kathleen Cekanski-Farrand it was determined that there is no conflict <br />of interest. <br /> <br />Councilmember Henry Davis advised that his wife is a graduate of St. Joseph High <br />School. <br /> <br />th <br />Mayor Stephen Luecke, 14 Floor County-City Building, 227 W. Jefferson Blvd., South <br />Bend, Indiana, made the presentation for this bill. <br /> <br />Mayor Luecke advised that there are four components of the bill. $60,000 for <br />Engineering work to move city utilities which will be in the right of way which will be in <br />the way of the realigned U.S. 31 as it comes into the Southside of South Bend. $40,000 <br />for a water pump at Ebel Golf Course. $50,000 to repair piers on the riverwalk at the <br /> 4 <br /> <br />
