REGULAR MEETING October 8, 2018 <br /> Councilmember Gavin Ferlic made a motion to adopt Bill No. 18-58. Councilmember John Voorde <br /> seconded this motion which carried by a roll call vote of nine (9) ayes. <br /> RESOLVE INTO THE COMMITTEE OF THE WHOLE <br /> At 7:41 p.m. Councilmember Karen White made a motion to resolve into the Committee of the <br /> Whole. Councilmember Gavin Ferlic seconded the motion which carried by a voice vote of nine <br /> (9) ayes. Councilmember Gavin Ferlic, Chairperson,presiding. <br /> Councilmember Gavin Ferlic explained the procedures to be followed for tonight's meeting in <br /> accordance with Article 1, Section 2-11 of the South Bend Municipal Code. <br /> PUBLIC HEARINGS <br /> BILL NO. <br /> 34-18 PUBLIC HEARING ON AN ORDINANCE OF <br /> THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, ANNEXING TO AND <br /> BRINGING WITHIN THE CITY LIMITS OF <br /> SOUTH BEND, INDIANA, AND AMENDING <br /> THE ZONING ORDINANCE FOR PROPERTY <br /> LOCATED IN PORTAGE TOWNSHIP, <br /> CONTIGUOUS THEREWITH; COUNCILMANIC <br /> DISTRICT NO. 6, FOR A 31.75 ACRE TRACT <br /> OF LAND ON THE WEST SIDE OF NEW <br /> ENERGY DRIVE APPROXIMATELY 350 FEET <br /> NORTH OF STATE ROAD 23, SOUTH BEND, <br /> INDIANA <br /> Councilmember Karen White made a motion to hear the Substitute version of Bill No. 34-18. <br /> Councilmember Tim Scott seconded this motion which carried by a voice vote of nine (9) ayes. <br /> Councilmember Oliver Davis, chair of the Zoning and Annexation Committee, reported that they <br /> met this afternoon and send this bill forward with no recommendation. <br /> Angela Smith,Deputy Director of the Area Plan Commission with offices located on the 11th floor <br /> of the County-City Building, South Bend,IN,served as the presenter for this bill.Ms. Smith stated, <br /> Before you is an amended ordinance. First(1St) of all,there is a typographical error and it is sixty- <br /> one point seven-five (61.75) acres and not thirty-one point seven-five (31.75). The major change <br /> here is, after the Committee discussion,the petitioners are requesting the zone change to LI, Light <br /> Industrial as opposed to the originally proposed GI, General Industrial District. The Light <br /> Industrial District limits the uses to ones that have clean, quiet and free of hazardous or <br /> objectionable elements such as noise, odor, dust smoke or glare, uses. They felt that would be a <br /> good compromise to help address any concerns of the adjacent neighbors that came to the <br /> Committee meeting this afternoon. So this particular property is on the east here and is sixty-one <br /> point seven-five(61.75)acres. To the north you have the GI, General Industrial District in the City <br /> of South Bend. To the east is LI. To the south is a property rezoned not too long ago to CB, <br /> Community Business. And the other property to the west is a property that will be heard later and <br /> is being petitioned to seek annexation and rezoning also. This property along with the other one <br /> (1) is kind of a little bit of an island. It is bound by the bypass on one (1) side, existing industrial <br /> development to the east and a railroad spur to the north. All of that kind of isolates this to the <br /> surrounding agricultural area. This map (referencing a slide in a presentation which is available in <br /> the City Clerk's Office)kind of gives that illustration there. You can see how this is the last general <br /> area in this area to the southeast of the railroad tracks. The comprehensive plan for this area calls <br /> for heavy industrial use but the petitioner is seeking Light Industrial to make sure they mitigate <br /> the effect on surrounding properties. This comes to you from the Area Plan Commission with a <br /> favorable recommendation. <br /> 8 <br />
