<br />Be It Resolved by the Board mf- Public `forks of the City of Souti? Bend,
<br />St, Joseph Counter, State of Indiana, that it it desired and deemed necessary to improve
<br />earth Shore Drive from Michigan Street to Leepir Avanua as follows, to -wit: -
<br />Said Street
<br />hall be graded and the roadway thereof shall ba aved; and also the roadway of certain
<br />portion;, of the, streets and alleys which entar° j i.r intersect said street shall be graded
<br />and paved. The paving material to be used in making said' improvement shall be Portland

<br />The cost of the improvement herein provided for, except atreet and alley tatersections, shall be paid by
<br />epeetal assessment to be levied upon the property specially benefitt id, to the amount that`the same may be leg-
<br />ally assessed therefor, in accordance with an Act of the Genera, Assembly of the State: of Indiana, entitled
<br />"An Act Concerning Mi—n—cipal Corporations," approved March f. 1905, and in accordance with and pursuant
<br />to the provisions of all acts amendatory and supplemental thereto ,
<br />The cost of all street and alley intersections, including one-h af of the width of the improvement uptjo-
<br />site street" and alleys which run ir.to, but do z,ot cross s id roadway herein proposed to be impyoved and' that
<br />portion of such street or alley abutting upon property bolonging tc said City, or upon property not subject to
<br />such Aisestment, shall be paid by the City in cash out of its genes-1 fund, if able to do ed, or from a fund cre-
<br />ated by a special as!essment to be ;ivied under the provisions of Section l0ai of the .;bcve entitled Act.
<br />Assessments of ten dollars and more aFA..nst each lot, if de erred, aze to be paid in ten equal annual ln-
<br />staliments, :ol interest at the rite of six per cent per annum. A bond or bonds will be issued to the con-
<br />tractor to the amount of such deferred assessments in pro rota pap e-t for such impr�er Apt.
<br />Under no circumstances shall ibe city of South Dend be, or be held responsible for any sum or `subs due
<br />from said property owner or owners for said work, or for the collection of the same, or for the payment ot,an
<br />bond, beds, certificate or certnIcates, 'issued to said cop.tractor i pavmen.t .or sucu work, except foi uX °
<br />moneys as shall have actually been received by the City from the assessraents for such improvement, bt -such
<br />moneys as said City is by said entitled Act and amendment and sul3piements thereto required to pay. All
<br />proceedings had, and work done in the making of said i:� :_ovemen r-e7essrn-ent of property, collection of ass
<br />sessments and issuance of bonds therefor, shall be as provided for in said above e;ititled Act, and Acts amend-
<br />story thereof and supplemental thereto. !
