Niblock Excavating Inc. <br />PO Box 211 <br />Bristol Indiana 46507 <br />Phone 574.848..4437 <br />Fax 574.848.4575 <br />January 2, 2018 <br />:employee Drug Testing Policy <br />It is the policy of Niblock Excavating, Inc. to maintain a drug -free workplace and conduct testing <br />required by Indiana law (IC 4-13-18) to discourage the use of prohibited substances by our <br />employees. The revised drug testing policy consist of the following steps: <br />(1) All field employees will be subject to random drug testing at least one (1) time each year. <br />(2) A master employee list will be kept by the certified drug testing facility. This list will be <br />used for the drug testing "pool". The certified facility is responsible for the selection of <br />subjects for the random testing. <br />(3) At least two percent (2%) of the subject employees will be randomly selected for testing <br />each month. <br />(4) Once an employee has been notified of his/her selection for testing, they will be taken or <br />directed to the certified facility to provide a specimen. <br />(5) Specimens will be tested for amphetamines, cocaine, opiates (2000ng/ml), PCP, and <br />THC. <br />(6) All test results will be reviewed by a Medical Review Officer (MRO) from the certified <br />lab. The MRO shall be a licensed doctor of medicine or osteopathy. <br />(7) The concentration thresholds established under 49 CFR Part 40.87 will determine <br />whether a drug test is positive or negative. <br />(8) If the MRO notifies Niblock Excavating, Inc. that an employee has tested positive, the <br />following disciplinary progression will be followed, unless Niblock Excavating, Inc. <br />determines that it is in the company's best interest to terminate the employee: <br />(A) After the first positive test, an employee must be: <br />(i) suspended from work for thirty (30) days. <br />(ii) Directed to a program of treatment or rehabilitation; and <br />(iii) Subject to unannounced drug testing for one (1) year. <br />(B)After a second positive test, an employee must be: <br />(i) Suspended from work for ninety (90) days. <br />(ii) Directed to a program of treatment or rehabilitation; and <br />(iii) Subject to unannounced drug testing for one (1) year. <br />(9) All subcontractors for work to be performed on state public works contracts will include <br />a provision requiring the subcontractor to have a drug testing policy that complies with <br />IC 4-13-18 and to provide information regarding implementation of its drug testing <br />program upon request of the owner agency. <br />
