J b Zd - (~Sp A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING A PETITION OF THE SOUTH BEND BOARD OF ZONING APPEALS FOR THE PROPERTY LOCATED AT (640 AND 560 WEST IRELAND ROAD, SOUTH BEND, INDIANA) WHEREAS, Indiana Code Section 36-7-4-918.6, requires the Common Council to give notice pursuant to Indiana Code Section 5-14-1.5-5, of its intention to consider Petitions from the Board of Zoning Appeals for approval or disapproval; and WHEREAS, the Common Council must take action within sixty (60) days after the Board of Zoning Appeals makes its recommendation to the Council pursuant to I.C. 36-7-4-918.6; and WHEREAS, the Common Council is required to make a determination in writing on such requests pursuant to Indiana Code Section 36-7-4-918.4, and WHEREAS, the South Bend Board of Zoning Appeals has made a recommendation, pursuant to applicable state law. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: SECTION I. The Common Council has provided notice of the hearing on the Petition from the Board of Zoning Appeals pursuant to Indiana Code Section 5-14-1.5-5, requesting that a Special Exception be granted for the property located at: (640 AND 560 WEST IRELAND ROAD, SOUTH BEND, INDIANA 46614) in order to permit: The Approval of a Special Exception to allow the operation of a Automotive sales, repair and service facility on property presently zoned "CB" Community Business District. SECTION II. Following a presentation by the Petitioner, and after proper public hearing, the Common Council hereby approves the petition of the South Bend Board of Zoning Appeals, a copy of which is on file in the Office of the City Clerk. SECTION III. The Common Council of the City of South Bend, Indiana, hereby finds that: 1. The proposed use will not be injurious to the public health, safety, comfort, community moral standards, convenience or general welfare; 2. The proposed use will not injure or adversely affect the use of the adjacent area or property values therein; 3. The proposed use will be consistent with the character of the district in which it is located and the land uses authorized therein; 4. The proposed use is compatible with the recommendations of the City of South Bend Comprehensive plan; all of which is requested by the South Bend Municipal Code § 21-09.03 (i). SECTION IV. Approval is subject to the Petitioner complying with the reasonable conditions established by the Board of Zoning Appeals which are on file in the office of the City Clerk. SECTION V. The Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. THIS REAL ESTATE IS COMMONLY DESCRIBED AS: 640 and 560 West Ireland Road, South Bend, Indiana 46614. The Petitioners are the owners of the real estate parcel shown on the attached site plan and as shown in the records of the St. Joseph County, Indiana Auditor's office. The Petition property presently has a Zoning classification of "CB" Community Business District. The Petitioners desire to build an Automotive sales, repair and service facility. Even though the property has a zoning classification that allows for several commercial type uses, the ordinance requires that for the proposed automotive use, a Special Exception is required to be approved. 2 The attached site plan shows the location of the proposed use within the Erskine Commons Development. It would be located at the Northwest corner of the project site North of the Wal-Mart and the Lowe's buildings, which are under construction. Access to the facility would be from one of the main interior driveways located along the Eastern side of the proposed facility. As shown, the building would have a first floor area of approximately 54,688 square foot with a partial second floor area of approximately 4,940 square foot. The building would have an interior display area along the Eastern portion of the building and an exterior display area of vehicles would be along the East and North side of the site. Due to elevation differences, there will also be a retaining wall along a large portion of the North side of the site. The remaining portion of the building square footage would include 30 service bays areas, a parts and supply area, customer lounge and sales offices and administration offices. With regards to the Special Exception, the Petitioners would state that this proposed use fits well within the commercial corridor for this section of Ireland Road and that there are other similar dealerships located on Ireland Road East of this site. The Petitioners would state that they do not believe that approval of this use would adversely affect the public health, safety, comfort, community moral standards, convenience or general welfare. With the proposed use being a new facility and meeting the City's latest zoning classification development standards, the Petitioners would state that approval of the special use should not injure or adversely affect the use of the adjacent area or property values. The petitioners believe the proposed use is consistent with the character of the district and the uses that are permitted in said zoning classification. The Petitioners also believe that the proposed use is compatible with the recommendations of the City's Comprehensive plan, all of which is requested by the South Bend Municipal Code § 21-09.03 (i) and which has designated this area for commercial type uses. The Petitioners contend that the strict application of the terms of the Zoning ordinance will constitute an unusual and unnecessary hardship as applied to the property for which the Special Exception is sought and that approval of said Special Exception would not adversely affect the use or value of the area adjacent to the property described in the petition and the Special Exception will not be injurious to the public health, Safety, morals, or general welfare of the community.
