ORDINANCE NO. <br />AN ORDINANCE OF THE COMMON COUNCIL OF <br />THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 4, ARTICLE IV, <br />SECTION 4-30, TITLED HOTELS AND MOTELS, OF THE SOUTH BEND <br />MUNICIPAL CODE <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend is committed to the health, safety and welfare of its residents. It <br />is also a high priority of the Common Council to provide for the health, safety and welfare of <br />visitors to the City. <br />Certain hotels and motels (collectively "hotels") can have disproportionately high rates of <br />police and emergency calls for service, violence, prostitution and drug activity which can have a <br />negative impact on health, safety and welfare of the community. <br />Because there is no common set of operating standards within the hospitality industry <br />that defines and shapes the obligation of hotel and motel businesses to their guests and the <br />surrounding community, it is the intent of the Common Council to proactively establish local <br />health, safety and welfare standards for hotels in the City of South Bend that will help create a <br />vibrant and robust environment for the, enjoyment of it tourists, visitors, residents and businesses. <br />These amendments to the South Bend Municipal Code establish a program by which the <br />City may measure criminal activity in hotels and then reduce the harmful effects of that criminal <br />activity through various measures proven to be effective in other parts of the country. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA as follows: <br />Section I. Chapter 4, Article IV, Section 4-30 of the South Bend Municipal Code <br />shall be deleted in its entirety and amended to read as follows: <br />Section 4-30. Hotels and Motels. <br />(a) Definitions. As used in this section, unless otherwise expressly stated, the following words <br />and phrases shall have the following meanings: <br />(1) Calls for Service includes but is not limited to any and all calls to emergency services <br />(police, fire, medical, Code Enforcement) that result in a representative being dispatched or <br />directed to the hotel. This shall include any calls for service within the surrounding <br />neighborhood that through information or investigation can be traced to the hotel staff, registered <br />-1- <br />
