SUPPLEMENTAL AGREEMENT NO. 2
<br />This Supplemental Agreement No. 2 is made and entered into this day of
<br />, 2011, by and between the CITY OF SOUTH BEND, INDIANA, acting by and
<br />through the BOARD OF PUBLIC WORKS, hereinafter referred to as the "OWNER ", and
<br />DLZ INDIANA, LLC, 2211 East Jefferson Boulevard, South Bend, Indiana 46615,
<br />hereinafter referred to as the "ENGINEER ".
<br />WHEREAS, the OWNER and ENGINEER did, on July 23, 2007 enter into an
<br />agreement for preparation of construction documents for certain street improvements
<br />along Michigan Street, Madison Street, Marion Street, Lafayette Street and Main Street,
<br />WHEREAS, the OWNER did, on April 12, 2010, enter into a Supplemental
<br />Agreement No. 1 for the improvements along Michigan Street, Madison Street, Navarre
<br />Street, Bartlett Street, Lafayette Street and a consolidated parking lot bounded by
<br />Michigan, Main, Madison and LaSalle Streets.
<br />WHEREAS, the OWNER has requested certain additional services and
<br />changes not included in the original contract or supplemental agreement,
<br />specifically the design of a consolidated parking lot bounded by Michigan, St.
<br />Joseph, Marion and Navarre Streets (Area 1), the design of a consolidated
<br />parking lot, Gateway Lot, bounded by Michigan, Main, Marion and Madison
<br />Streets (Area 2), and the design of a new entrance into the Memorial Hospital
<br />(Memorial Drive) and reconfiguration of the parking lot bounded by Michigan,
<br />Main, Bartlett Streets and Park Lane (Area 3).
<br />NOW THEREFORE, the OWNER and the ENGINEER desire to amend the
<br />above referenced Design Contract as follows:
<br />Add Sections A.18 -A.21 to Appendix "A" as follows:
<br />18. Recover and re- establish horizontal and vertical control for the three
<br />sites, tying into neighboring Memorial Hospital projects.
<br />19. Complete topographic survey for the parking lot located on the block
<br />encompassed by the following streets: Marion, Michigan, Navarre
<br />and St. Joseph. Topographic mapping will be from edge of lot to
<br />edge of lot on all sides, including all access drives to surrounding
<br />streets. Total area of this site is 2 acres (Area 1) (Figure 3).
<br />20. Complete topographic survey for the parking lot located on the block
<br />encompassed by the following streets: Madison, Main and Michigan,
<br />including only those tracts owned by Memorial Hospital and the
<br />alleys. Topographic mapping will be from the edge of pavement
<br />surrounding the Memorial Hospital tracts to 30' toward the interior of
<br />the block and also all of the north -south alley. Total mapping area of
<br />this site is 0.6 acres (Area 2) (Figure 4).
