addition St. Joseph County shall reimburse South Bend for any necessary costs South Bend actually <br />incurs in connection with any on-duty injury suffered in connection with the agreement, both under <br />I.C. 36-8-4-5 and, if recall is necessary, for the replacement cost of the firefighter so injured. <br />7. Until such time as modified by the joint board, South Bend may charge ambulance/medical <br />user fees in accordance with § 10-20-050 of the St. Joseph County Code as set forth in the attached <br />Exhibit A. <br />8. South Bend shall make reasonable efforts to collect from the Unincorporated County <br />ambulance patients served under this agreement all due payments and shall return all such monies <br />collected to St. Joseph County within thirty (30) days of receipt, except as provided herein. South <br />Bend will provide detailed monthly reports to St. Joseph County concerning collections, payments, <br />and runs made pursuant to this agreement. South Bend shall reimburse LibertyTownship Ambulance <br />Service, the town of Walkerton, Union North Ambulance Service and New Carlisle Ambulance <br />Service fifty percent (50%) of any payment received for services rendered for an ALS assist in said <br />localities prior to disbursal of funds to St. Joseph County. <br />9. Both parties recognize that under certain circumstances proper medical procedure may <br />require that the two (2) persons assigned to the ambulance provide medical care to the patient and <br />that the ambulance be driven by an EVOC-Certified volunteer firefighter from another township <br />within St. Joseph County. In the event of an automobile accident or occurrence under such <br />circumstances, St. Joseph County agrees to indemnify and hold harmless South Bend from any and <br />all claims, actions, causes of actions, demands, damages, costs and expenses whatsoever for which <br />South Bend might be liable. <br />10. South Bend shall remain liable for the acts of its agents, employees and servants during the <br />performance of this contract. South Bend hereby undertakes and agrees to indemnify and hold <br />harmless St. Joseph County and its employees, officers, and agents from any and aII loses, expenses, <br />damages, claims, causes of actions, or judgments arising out of any negligent or intentional act(s) <br />or omission(s) of South Bend or its employees, servants or agents. The forgoing indemnification, <br />hold harmless and undertaking of St. Joseph County by South Bend shall not apply to any loss, <br />damage, expense, demand, claims, cause of action or judgment arising out of or caused by instances <br />covered in Paragraph 9 of this agreement or arising out of a communications system other than the <br />South Bend Police Department Communications Center. <br />11. In addition to the monies mentioned in Paragraph 6, St. Joseph County shall reimburse South <br />Bend for all overtime costs incurred by South Bend arising out of the pregnancy of any female <br />firefighter regularly assigned to an ambulances covered by this agreement. <br />12. The Governing Board of this joint agreement shall meet at least semi-annually. <br />13. South Bend shall perform all routine maintenance on the ambulance. South Bend will bill <br />St. Joseph County monthly for aI1 repairs, labor for repairs, and fuel used on the ambulances. <br />Supporting documentation will be provided if requested by St. Joseph County.
