<br />STREET OR ALLEY IMPROVEMENT RFSOLUTION NO. 1106,

<br />Be it Resolved by the Board of Public Works of the City of South Bend,
<br />St. Joseph County, State of Indiana, that it is desired and deemed necessary to
<br />improve Woodward Avenue from Hudson Avenue to the Michigan Central-R. R. Co. and
<br />Angell& Avenue from Woodward Avenue to Portage Avenue as follows, topwit:-
<br />Said avenue shal,be graded and the roadway thereof shall be paved, and
<br />also the roadway of certain portions of thestreetsand alleys which enter or
<br />intersect said avenue shall be graded and paved. The paving material to be used
<br />in making daid improvement shall be Sheet Asphalt, Bitulithic, Asphaltic concret
<br />brick or Portland cement concrete pavement, seven (7) inches thick, ,and the found
<br />tion shall be Portland cement concrete six (6) inches thick for the Sheet asphal
<br />bitulithic, asphaltic concrete and brick, or rolled gravel six (6) inches thick
<br />for the brick, also cement curb shd cement sidewalk shall be constreted along
<br />both sides of said avenues where same is necessary and not already,constructe.d,
<br />manholes, storm water inlets and conduits shall be constructed where necess-,,ary,
<br />all manhole tops and storm water inlets shall be set to the proper'grade, cement
<br />marginal curb shall be constructed at all street and,.alley intersections where
<br />necessary, all.as is more particularly shown and all in accordance with the
<br />plans, profiles, detail drawings and specificaions on file in the office of the
<br />Department of Public Works of the City, of South Bend, Indians.
<br />The cost of the improvement herein provided for, except street and alley intersections, shall be paid. :by
<br />special assessment tp, be levied upon the property specially benefitted, to _the amount that the same may be leg=
<br />ally assessed therefor, In accordance with an Act of the General Assembly of the State of Indiana, entitled
<br />"An Act 'Concerning Municipal Corporations," approved March S. 1905, and An accordance with and pursuant
<br />Ts the vrovigoas of ,all acts amendatory and idurplemental thereto.
<br />:The cost of all, street and alley intersections, inclu'?ing one-half of the width of the
<br />gate street and alleys which run into, but do not cress sz d roadway het.aiu proposcd to be lmprov` i wi4 that
<br />pertion of.such street or alley abutting u .cit prc�erty belo-girg to s^id City, or upon property not s-,,u)ject to
<br />such ,a. a .-r ent, shall be paid by the City in ca3h out of its ger_er-1 fn7d, if able to do so, or from a fund cre-
<br />ated -by a special assessment to be, i,;✓ied under the provisions of section 108 of the above entitled Act.
<br />Assessments Of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual in-
<br />atallments, :rsth interest at the rate of. Six per cent.per annum. A bond or bonds will be issued to the cou-
<br />tractor to th% amount of such deferred assessments in pro rats payment for such improvement.
<br />Under no circumstances sh^11 the city of South B.-id be, or be held responsible for any snm or sums due
<br />from mid property owner or o -. ors for said work, or for the collection of the same, .or fov the payment of any

<br />necessary to improve Fellows Street from Sample Street to Ewing Avenue as follow
<br />to -wit: -
<br />Said street shall be graded and the roadway thereof shall be
<br />paved, and also the roadway of certain portions of the streets and alleys which
<br />enter or intersect said street shall be graded and paved. The paving material -
<br />to be used in making said improvement shall be Sheet Asphalt, Bitulithic:,
<br />asphaltic concrete, brick or Portland cement concrete pavement seven (7) inches
<br />thick, and the foundation shall be Portland cement concrete six (6) inches trick
<br />for the sheet asphalt ,'bitulithic, asphaltic concrete and brick, or rolled
<br />gravel six (6) inches thick for the brick, also cement curb shall be constructed
<br />along said street where same is necessary and not already constructed, manholes,
<br />storm water inlets and conducts shall be constructed where necessary, all manhi
