<br />The following agreement and bond was approved by the Board.

<br />This agreement between the City of South Bendj by and ,throu! h
<br />its Board of Public Works, party of the first part and. Louis Cohen,_, of South Bond
<br />Tndianal party of the second part.0 Witnesseth:
<br />That, the said first partyg in consideration of the prmi I ses and
<br />agreements�hereafter contained, on the part of the second party, promises an. agrees
<br />to permit said second party to close Grant Street in said City betleen Delewa,re
<br />Street and Prairie Avenue, upon the following terms and conditions*`
<br />Said second party agrees to grade said Grant)Street in accord-
<br />an6e with plans and' profiles prepared And farnished by the City Enjin ' eer of the City
<br />of South Bendq and complete said work within .one -(l) year from the_ -date of this con-
<br />tract. Said'second patty further agrees to furnish bond with surety .to be approved
<br />by first party, in the sum of One.Thousand (SIg000.00) Dollars to indemnify th6 City
<br />against any liability for damages to person or property by reason of the clsoing of said
<br />street for the improvement thereof as above provided , and provided further that said
<br />second party agrees that in the event that he shall fall to complete said work within
<br />the time above limited, said first party may complete said work'and recover of secadd
<br />party the amount exppnded in so doing, --It is understood and agreed that all of the
<br />work done by said second party is done in consideration for *the privilege of closing
<br />said street and without any liability on the part of the City of South Bend for the
<br />expense of said improvement$ In the event that said second party desires an extension
<br />of time for the complettion- of said work, he shall 84ke a formal, request of the
<br />Board of Public Works of said City fora such extension within aVleast sixty (60) days
<br />prior to the time fixed for the completion of said work#
<br />This contract shall not be effective -until the bond above
<br />provided for shall be filed and approved by the Board of Nablic Workt,
