ORDINANCE NO. <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, APPROVING AN AMENDMENT TO ARTICLE III OF THE LEASE AND <br /> MANAGEMENT AGREEMENT BETWEEN STUDEBAKER NATIONAL MUSEUM, <br /> INC.,AND THE CITY OF SOUTH BEND. <br /> STATEMENT OF PURPOSE AND INTENT <br /> On August 12, 2005 the City of South Bend entered into a Lease and Management <br /> Agreement with Studebaker National Museum, Inc., the Management portion of which (Article <br /> III) expired on December 31, 2010. Throughout 2011 the parties have continued their <br /> contractual Management Agreement on a month to month basis, and they desire to amend and <br /> renew their original Management Contract for another five year term. <br /> Studebaker National Museum performs a valuable service to the City by its preservation, <br /> public display, and educational programs relating to the Studebaker automobile and the City's <br /> Studebaker related Collection and Archives. Therefore, it is desirable and in the best interests of <br /> the City and its citizens that Article III of the Lease' and Management Agreement with <br /> Studebaker National Museum be amended and renewed per the attached Amended Agreement. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA as follows: <br /> Section 1. The First Amendment to the Lease and Management Agreement, at <br /> Article III, between the City of South Bend and Studebaker National Museum, Inc., attached <br /> hereto as Exhibit "A" be and hereby is approved. <br /> Section I1. The Board of Public Works is authorized to execute on behalf of the City <br /> of South Bend the First Amendment of the Lease and Management Agreement, Article III, <br /> attached hereto as Exhibit "A". <br /> Section III. The effective date of the Amendment to Article III of the Agreement is <br /> January 1, 2011. <br /> Section IV.
