42(1' <br />Board met in regular session at 9:00 A.A. L. P. Hardy absent. <br />Attorney G. A. Elliott at peared before the Board and presented <br />petition for vacation of ai alley as follows: - <br />To the Honorable Board of Public Forks, <br />South Bend, Indiana. <br />Gentlemen: - <br />The undersigned petitioner respectfully shows to the Board thathe is <br />the owner of the following pieces'of real estate both situated on Lincoln Way Test <br />In the City of South Bend, Indiana, to )wi!,:. <br />10 A lot or "parcel of land having a frontage f forty <br />• .(40) feet on Lincoln Way Test, taken off of and <br />from the entire width of the Easterly ends of Lots <br />numbered Twenty-five (25) and Twenty-seven (27) <br />as shown on the recorded Plat of Witherill's Second <br />Addition to the City of South Bend, which part is bounded <br />by a line running as follows, via; Beginning at the <br />point of the intersection of the southerly line of said <br />-incoln Way West with the East line of paid Lot No. <br />Twenty sven (27) thence running Northwesterly along <br />the Southerly line of said Lincoln Way West, a distance of <br />forty (40) feet; thence south parallel with the east <br />easterly line of said Lots Nos. Twenty -Five (25) and <br />Twenty seven (27) , a distance of seventy-nine and eight <br />tenths (79.8) feet to the Southerly li a of said Lot ARo. <br />Twenty-five (25) ; thence South Easterly along said d, <br />southerly line of said Lot No. Twenty-five (25), a <br />distance of forty (40) feet to the Southeasterly corner <br />of said Lot No. Twenty-five (25); thence north seventy <br />nine and eight tenths (79.6) feet to the place of <br />beginning. <br />2. A part of Lot No. One (1) as shown on the recorded plat of <br />Rockstroh and Nickel's .Addition to the City of South Bend, <br />bounded by a line running as follows: Beginning atht north <br />west corner of said Lot No. One (1); thence running south on the <br />west line of said Lot, a distance of One Hundred Twenty (20) <br />feet; thence east forty two and seventy four and one half <br />hundreths (42.74) feet to the east line of said Lot, thence <br />north on said East line to tho northeast cornerof said Lot: <br />thence Northwesterly on the Northerly line of said lot a <br />distance of forty-six (46) feet to the place of beginning. <br />That on -the 3rd. day of-March,1875, the toFmer owners of the <br />property Described as No. One (1)'above recorded a plat of said land known as the <br />0. S. Witherill 2nd.�Addition to the City of South Bend, which plat lays out and <br />dedicates to public use as an alley, a strip o land seven and one-half.(71) <br />links wide taken off and from the entire east end of Lots Twenty-three (23) <br />twenty-flve_-(�5) and Twenty-seven(27) of said plat As shown of Plat Book Three(3) <br />Page forty three (43). <br />That the paccels described above and owned by this petitioner <br />are situated on either side of the bove strip named for alley purposes in said <br />plat,.and the strip divides about equally the property of eighty -six (86) feet <br />frontage on Lincoln Way West of this petitioner. T is petitioner desires to <br />build an the property adjoining and definite action nnot be taken until <br />the disposal of the Four and Ninety-five hundreths (4 95) feet referred to has <br />been taken., Pet,ition&r would further sho',V that the four and ninety-five hundreths <br />(4.96) feet has never been used for alley purposes, an the same is not available <br />for alley purposes because of its width. That all of the lots in the Block <br />bounded by Lincoln Way West on the North Harrison Avenue on the Fast and Sherman <br />Avenue on the Test, Fuerbringer Street on the South are all so situated and have <br />access to streets and alleys having the necessary widths to be used at the present <br />time. <br />Wherefore, this petitioner now asks this Board that the strip of <br />land described In the 0. S. Witherill 2nd. Addition Plat, being seven and one <br />half (71) links in width running North and SouiA taken off the mire East ends <br />of lots twenty-three (23), twenty five (25) and ?'wenty-seven (27) of said plat be <br />vacated, and that the necessary resolution be adopted conforming to that purpose, <br />FILED LEWIS KVTOUSE <br />` SEPT. 1291922.
