2. By Owner: <br />a. The Owner is a municipal corporation organized under the laws of the State of Indiana, <br />and is self -insured under provisions of Indiana statutes and local ordinance. Specifically, <br />the Owner maintains blanket insurance coverage over real and personal property, and is <br />covered by a non -reverting insurance premium and liability reserve fund created by the <br />City of South Bend Ordinance #6657-79, pursuant to Indiana Code 3443-3-4 as <br />amended from time to time. Under said statute, the Owner's liability is limited to: <br />1) $700,000 for a cause of action that accrues on or after January 1, 2008; and <br />2) $5,000,000 for injury to or death of all persons in that occurrence; and <br />3) A governmental entity or an employee of a governmental entity acting within the <br />scope of employment is not liable for punitive damages. <br />B.
