ORDINANCE NO. � 0 � �� �) <br /> AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY <br /> LOCATED AT 3500 BLOCK OF EAST MCKINLEY AVENUE AND 600 BLOCK <br /> OF HICKORY ROAD, COUNCILMANIC DISTRICT FOUR, IN THE CITY OF <br /> SOUTH BEND, INDIANA <br /> STATEMENT OF PURPOSE AND INTENT <br /> THE LAND IS VACANT AND CURRENTLY ZONED CB — COMMUNITY <br /> BUSINESS AND IS BEING CHANGED TO PUD — PLANNED UNIT <br /> DEVELOPMENT. THIS WILL ALLOW THE SITE TO BE DEVELOPED INTO A <br /> VARIETY OF USES TO INCLUDE THE CURRENT COMMERCIAL <br /> DEVELOPMENT AND ADDING SINGLE FAMILY, MULTI-FAMILY AND SELF <br /> STORAGE. THE PURPOSE OF THE NEW ZONING IS TO ALLOW THE LAND <br /> TO BE DEVELOPED IN A MANNER THAT IS MARKET DRIVEN AND <br /> FLEXIBLE IN ORDER TO ALLOW SUCCESSFUL DEVELOPMENT. <br /> NOW THEREFORE BE IT ORDAINED by the Common Council of the City <br /> of South Bend, Indiana as follows: <br /> SECTION 1. Ordinance No. 9495-04, is amended, which ordinance is commonly <br /> known as the Zoning Ordinance of the City of South Bend, Indiana, be and the <br /> same hereby is amended in order that the zoning classification of the following <br /> described real estate in the City of South Bend, St. Joseph County, State of <br /> Indiana: <br /> Lots 1 & 3 of the McKinley- Hickory Minor Subdivison <br /> be and the same is hereby established as PUD — Planned Unit Development. <br /> This ordinance shall be subject to the written commitments outlined in the Area <br /> Plan Commission Staff Report on page 3 where four (4) items addressing <br /> screening, landscaping, and height restrictions are set forth. <br /> SECTION II. This ordinance shall be in full force and effect from and after <br /> its passage by the Common Council, approval by the Mayor, and legal <br /> publication. <br />
