RESOLUTION NO. 991 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY TO THE CITY OF SOUTH BEND WHEREAS, the South Bend Redevelopment Commission owns the following described real property situated in St. Joseph County, Indiana: A parcel of land in the Southwest Quarter of Section 12, Township 37 North, Range 2 East, City of South Bend, Portage Township, St. Joseph County, Indiana, being Lots 6 and 7 of Birdsell Mfg. Co. Subdivision as recorded in Book 1, Page 48 at the St. Joseph County Recorder's office in South Bend, Indiana and described as follows: COMMENCING at an iron on the Northwest corner of Lot 9 in Birdsell Mfg. Co.'s Subdivision and also being on the East right -of -way line of Columbia Street; thence South 00 °00105" West (bearing assumed), 87.00 feet along said East right -of -way line to the Point of Beginning; thence North 88 021117" East, 134.70 feet to the West right -of -way line of a 10.00 foot alley; thence South 00 °00'05" West, 101.00 feet along said West right -of -way line; thence South 88 021117" West, 134.70 feet to the East right -of -way line of Columbia Street; thence North 00 000'05" East 101.00 feet along said East right -of -way line to the Point of Beginning, and containing 0.3123 acres, more or less, and is subject to all easements, restrictions and or covenants of record. Commonly known as 622 South Columbia Street, South Bend, (the "Real Property "); and WHEREAS, the Commission is desirous of transferring the Real Property to the City of South Bend, Indiana; and WHEREAS, the City of South Bend is desirous of accepting the transfer of the Real Property from the Commission; and WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend (the "Board ") has custody of and may maintain all real property of the City of South Bend; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend, +acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Commission has agreed to transfer the Real Property to the City of South Bend, and the City of South Bend, acting by and through the Board, has agreed to accept the transfer of the Real
