PETERS. <br />Property owners on Harrison Avenue from Lincoln Way to California <br />Avenue before the Board in regard to petition for.the paving of Harrison Avemso <br />Resolution Ordered prepared. <br />Attorney Barry Scanlon appeared before the Board in regard to <br />petition for pavement on the first alley Bast of St. Peter Street from Jefferson <br />Blvd. to the first alley north. Resolution ordered. <br />Building Commissioner Goo, A. Davis appeared before the Board and <br />presented communication received from Mr R. U. Miller in regard to &rage being <br />built in public allays - this`placedon file and referred to the City Aftonrey <br />to see if this -man as�a title to this alley. <br />Ger. July 27-22 <br />`Building Commissioner, <br />..South Bend, Ind. <br />:Dear Sir:- Pursuant to your request that I furnihh you with data in support of.my <br />claim that the parcel if ground on which I have erected a garage is ground beloning <br />to mte, towit: Im lot No. 10 in the Sub -Division of Out Lot No. 1. of Hendricks <br />& Grant's *ddition to South Bend as laid out and platted by Eliaabatt Kent, Luc <br />Garrison and -Samuel Garrison, ;Rich lot No. 10 has a frontage of 63� feet on Mayrion <br />Street, I submit the following:- <br />First, I refer $ou to .the Plat of the First Nort4West Addition *f <br />South Bend platted by John Hendricks and John Grant, which plat is dated May 3-1837 <br />and © or saute is recorded in Plat Book No. 1. page 36 in the office of the <br />Recorder of St. Joseph County, which see* and also see pencil sketch of so much <br />there f as concerns the dubjest of this letter attached bvrete <br />It wi be noted that this plat shows an alley immediately west of <br />and adjoining lot Ns. 66of said mentioned plat which alley running north interested <br />an alley (at rear of in Lot No. 10y which latter alley ran along the South Side of <br />the Kankakee Yaee, both of which;the,latiAr alley and the race, have many years <br />ago been; closed up and the,griund thrown into the lets of abutting owners, dwelling <br />houses and other buildings crested thereon and otherwise improved: <br />The west half of lot No. 66 is owned by Woe. Smith and Barbara <br />Smith the complainants; <br />4esond I now refer you to said Kent & Garrison Sub -Division of <br />Out Lot No. 1, above mentioned, which see, and also see lead pencil sketch of so <br />mush thereof as soriserns the subject of: this letter attached hereto, which <br />,sub-Divisie n was laid out and platted Aug. 13-1881. in plat Book 4 Page 16, St. <br />Josobh County Reoords,and ask you to note that the portion of the sane containing in <br />Lot No. 10 imediately abuts and ad joins the , portion' of said lot No. 66 owned' ` <br />by said Smiths without reserving or creating any alley whatsoever. <br />At the time of platting said Sub -Division said Kents and'. <br />Garrisons owned lot 66, the alleyshown on said original North west Addition as, <br />abutting.the west side of it, and of course said out Lot No;. 1. containing the <br />present in Lot No. 10 now owned by undersigned. <br />In Sub -Dividing the said Kents and garrisons s&w fit to ftt-the <br />southeast,eorner of in Lot No, 10 at the southwest corner of in Lot No. 66 thereby <br />throwing the 14 foot strip of ground, formerly shown as an alley, in said First <br />North West Addition, Plat Book 1 Page 36, Bate In Lot No. 10 and making it a part <br />of said in Lot No. 10. <br />We call attention to the last named plat and ask you to note <br />that the distance from the alley corner t the southwest corner of In Lot No. 11 <br />isainnonly known as the Lumber Yard Alley to the southwest corner of In Lot No. 66 <br />is onw hundred and thirteen feet (113) and that the frontage of In Lot No 11 is <br />49i feet and the frontage of In Lot No. 10 is 631 feet making 113 feet, thereby <br />as stated, throwing the strip of ground in quest on into and making it a part of <br />In Lot No. 10. <br />
