<br />		l.  . You  did,  while  on duty,  on  or  about  F'ebruary  27,  1944,  at  or  about
<br />		the  hour  oz"  4:30  A.Iti7.  operate  and  propel  the  Police  Car  which  you  tivere
<br />		driving  on  and  into  a motor  vehicle  tnat  tiva_s  properly  parked  on  the  East
<br />		aide  of  P�Iicni�an  Street,   South,   in  the  22 00  Block  thereof,  in  the  City  of
<br />		South  Bend,   Indiana;   that,   immediately  prior  to  said  accident,   and  tivhile  �rou
<br />		���rere  on  dut�T,  you  had  partaken  of  intoxicating  liquors;   said �liquor  of
<br />		which you  had  partaken  rendered  you  unable  or  partiall�  unable  to  control
<br />		said  squad  car.
<br />		2.    Your  action,   as  above  alle�ed,  constitutes  conduct  injurious  to  the
<br />		Public  Peace  and  '�Jelfare,  and  constitutes  conduct  unbecomin�  an  �flficer
<br />		as  set  forth  in  Burns  Ind�.ana  Statutes,   1943,  Section  48-6105.    Said
<br />		conduct  f urther  constit�te`s  a  violation  of  rule  12  of  the  �ules  and
<br />		Re�ulations  of  th.�-•Police  Depart*_nent  of  South  Bend,   Indiana,   adopted  by
<br /> 		the  Board  of  Piiblic  '.Jorks  and  Safety.    Said  rule  provides  that  Police
<br />		�fficers  sl�all  not  conduct  themselves  in  a  disorderly manner,   or  in  a
<br />		manner  tivhich might  be  construed    b�  an  observer  as  disorderly,  and �shall
<br />		not  be  �uiltf  of  an�  conduct  or  ne;lect  of  duty  prejudicial  to  good  order
<br />       � 	and  discipline,  or  conduct  unbecoming  an  officer  and  a  gentleman.    Said
<br />		conduct  constitutes  a  violation  of  rule  14  of  said  Rules  and  Regulations
<br />		which  prohibits  anf  off icer  from  drinkin�  anf  alcoholic  or  intoxicating
<br />		liquors  while  on  dut�r,   that  officers  shall  not  buy  liquor  while  in
<br />		uniform,  nor  at  any  time  frequent  for  the  purchase  of,�{consumption  of,
<br />		liquor,  any  place-tiahere  into�icating  liquor  is  sold  for  soncumption  on  the
