REGULAR MEETING NOVEMBER 14, 2011 <br /> <br /> <br /> <br /> <br />Mr. Lyons advised that the petitions are seeking a special exception to allow for the <br />option of a single family dwelling on property located at 618, 622, 626, and 636 <br />Lincolnway East and vacant land east and adjacent to 701 South St. and 611, 613, and <br />702 South Street and 514 & 518 Rush Street and a special exception to be allowed to use <br />a portion of the properties as an accessory parking lot on properties located at 618, 622 <br />Lincolnway East, 611 South Street and 514 & 518 Rush St. Mr. Lyons advised that the <br />Area Board of Zoning Appeals held a public hearing on October 5, 2011 and sends it to <br />the Common Council with a favorable recommendation. <br /> <br />Mr. Mike Danch, Danch, Harner & Associates, 1643 Commerce Drive, South Bend, <br />Indiana, representing the City of South Bend Redevelopment Department. <br /> <br />Mr. Danch advised that the area in question is bounded by Lincolnway East, South Street, <br />and Rush Street. These properties were acquired by the Redevelopment Authority from <br />the South Bend Housing Authority. The Redevelopment Authority would like to be able <br />to put these properties back up for sale for either single ownership, duplexes or the multi- <br />family classification. He stated that a couple of these houses right now are being used as <br />single family; the other ones are being used as multi-family. Under the “MF1” zoning it <br />is not allowed to have a single family residence. So what they are trying to do is work <br />with the City of South Bend to make these properties sellable and provide enough options <br />for the city that if someone wants to buy these homes they would have the option to <br />continue to use them as duplexes, the ones that are that way, or single family depending <br />on how that worked out. Mr. Danch advised that they are also seeking a special <br />exception on the interior parking lot. He noted that under today’s code in order to have <br />that interior parking lot a special exception is needed to allow it under the “MF1” <br />category. He stated that they split up the parking lot between the different properties and <br />what will happen is that there will be a homeowners association that will end up taking <br />care of that. Through the subdivision process they will end up with an ingress/egress and <br />a parking lot agreement that will show up on those lots. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this Resolution, Councilmember Oliver Davis made a motion to adopt this <br />Resolution. Councilmember LaFountain seconded the motion which carried and the <br />Resolution was adopted by a roll call vote of nine (9) ayes. <br /> <br /> <br />RESOLUTION NO. 4127-11 A RESOLUTION SUPPORTING THE <br />INVESTMENT OF CAGIT, TIF, UDAG AND <br />CEDIT MONIES IN THE CHASE TOWER IN <br />DOWNTOWN SOUTH BEND <br /> <br /> <br />, <br />Whereas the Common Council of the City of South Bend, Indiana, notes that the <br />building located at 211-213 West Washington was constructed in 1971, consists of 25- <br />stories and is located in the heart of downtown South Bend; and <br /> <br />, <br />Whereas the Council further notes that the property is currently subject to an <br />“Agreed Order for Immediate Appointment of Receiver” in the St. Joseph Circuit Court; <br />and <br /> <br />, <br />Whereas the South Bend Common Council believes that this structure is vital to <br />the overall viability as an integral part of the economic engine because of its key location <br />in the county seat of St. Joseph County, Indiana; and <br /> <br />, <br />Whereas City Plan was adopted by the South Bend Common Council with the <br />adoption of Resolution No. 3657-06 in 2006 which specifically stressed within its <br />“Implementation Action Plan”, the need to: <br /> 17 <br /> <br />
