RESOLUTION NO. 1031 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />APPROVING AND AUTHORIZING THE TRANSFER OF <br />REAL PROPERTY TO THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the City of South Bend, Indiana, for the use and benefit <br />of its Department of Redevelopment, owns a certain parcel of real <br />property situated in St. Joseph County, in an area of the City of <br />South Bend commonly referred to as Monroe Park and more particularly <br />described as follows: <br />The triangular parcel on the westerly side of Lots <br />7 and 6 of Gallaghers lst Addition to the City of <br />South Bend. Key No. 18- 3035 - 1323.01 <br />(Real Estate) which Real Estate was acquired for redevelopment <br />purposes; and <br />WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment <br />Commission (Commission) is the governing body of the City of South <br />Bend Department of Redevelopment; and <br />WHEREAS, the Commission has determined that the Real Estate, or <br />some portion thereof, would best be used to provide public ingress to <br />and egress from Rush Streets; and <br />WHEREAS, pursuant to I.C. 36- 7- 14- 12.2(a)(3), the Commission may <br />transfer real property acquired for redevelopment purposes, to <br />another department of the City for use as public right -of -way, upon <br />any terms that may be agreed upon; and <br />WHEREAS, the City of South Bend, is desireous of acquiring the <br />Real Estate for use as right -of -way; and <br />WHEREAS, the City of South Bend, acting by and through its Board <br />of Public Works and pursuant to I.C. 36- 1 -11 -8, may acquire real <br />property from another governmental entity upon such terms and <br />conditions as may be agreed upon and upon the adoption of <br />substantially identical resolutions; and <br />WHEREAS, the Board of Public Works has or will adopt a resolution <br />substantially identical in its terms to the terms of this resolution; <br />and <br />WHEREAS, the Commission has determined that it is in the best <br />interests of the Commission, the Department of Redevelopment, and the <br />Redevelopment taxing district that the Real Estate be transferred to <br />the City for use and dedication of all or part of the same as <br />right -of -way. <br />NOW, THEREFORE, be it resolved by the South Bend Redevelopment <br />Commission as follows: <br />1. That the following- described real property, owned by the <br />City of South Bend, Indiana for the use and benefit of its Department <br />of Redevelopment, situated in St. Joseph County: <br />The triangular parcel on the westerly side of Lots <br />7 and 6 of Gallaghers 1st Addition to the City of <br />South Bend. Key No. 18- 3035 - 1323.01 <br />shall be and hereby is ordered transferred to the City of South Bend, <br />Indiana, for the sum of Ten Dollars ($10.00) and other good and <br />valuable consideration. <br />2. That the transfer of the Real Estate shall be by way of <br />quit -claim deed executed by the President and attested to by the <br />Secretary of the Commission. <br />
