Mar. 15,1922. <br />I am informed by our lineman at South -Bend, Ind. that he called Vppon you <br />to ascertain what poles were to be moved. He states tgat there is but one pole and that <br />stands in tl;e middle of 'a drivewa belonging to one of your citizens. <br />We will move this pole as soon as our gang returned to South Bend, They are <br />now up in Wisconsin rebuilding a sleet storm wreck. Hammond, <br />weth form for advertising attached same read and approved by the Board: <br />March 15,1922. <br />Board of.Public Works, <br />City of South Bend) Ind. <br />Gentlemen: -- <br />I have been asked by the Mayor to exmmnn.e,the legal notices recently published <br />by order of your Board, a copy of which is.enclosed herewith, and to advise your Board <br />upon the possiblity of cutting these notices down in order to save expenses of publica- <br />tion"s. It is my opinion that more than fifty -per cent-per.this sppace can be saved with - <br />.out affecting the validity of the notices. The following is the language of the Statute <br />with respect to the contents of the notice: <br />" Notice -of such resolution shall be published once each week for two weeka <br />which notice shall call attention to the passage of preliminary resolution and shall <br />state on a day named, not less than ten days from the date of the last publication when <br />the Board will hear all persons inte ested or whose propertyis liable to the assessed <br />for the proposed improvement, and will decide whether the bnefits to the property <br />liable to be assessed for such improvement will equal the estimated costs thereof," <br />Much -of the matter contained in the notices as printed is a repetition <br />nd much of it is not required by law to be stated in the notice for example, nearly all <br />ti4le notices describe in detail the character of construction of each improvement <br />followed by the statement that details, drawings , plans, and specifications are ell <br />filed in the office of the Board of Works. The law requires ftly that pp�roperty <br />olvners be notified of the passage of the preliminary* resolution and of the time fixed. <br />for the hearing and in my judgement the notice is sufficient if it idenitifies the <br />street or alley which is to be improved and fixes the day for the hearing. <br />I belie e the tax payers of the City can be saved thousands of <br />dallfars in this one item of advertising expense, particularly since under the present <br />law these notices are now required to be Oublished in two newspapers instead of one ad <br />as formerly provided. I inclose -;herewith a form which I believe would comply with all <br />the requirements of the Statute and will illustrate the manner in which these notices <br />may be publishdd. <br />Co of form submitted.
