52 AuguSig, 31 Board met in regular session at 10:00 A.I. All members present. ✓ Mrs. Jacob Kuntz appeared Before the Board and Piled a, remonstrance against an asphalt plant of the Western Construction Company being located at,Vandalia Ry. Company's round house yards on south Lafayette Str_Pet as same was regarded as a nuisance. The Board referred the above mentioned remonstrance to the City Attorney for c. report. Communication received from V. G. ?ones Attorney, in regard to petition 'filed for opening of South Scott Street from Sample Street to Three"I" Tracks, The Board instructed the clerk to notify Mr. Jones that said petition was up for hearing last year and turned down, and as they think this territory which this stret opening would affect) will be platted very soon. Attorney W. G. Crabill appeared before the Board and remonstranced against the Widening of Indiana Avenue and Webster Street representing Mr. J. D. Oliver. Pole and Wire Inspector reported that Poles at 1st. alley north of Portage Avenue on Vassar Avenue betweellWoodward Avenue and Portage Avenue, also ah Allen Street between Birner Street and Oak Street were already moved inside curb line,per City Engineer's instruction, the above report was approved by the Board. Petition filed for pavement on Indiana Avenue from Leer Street to Miami St. ✓ The same was read and referred to the City Engineer for investigation. Permission granted the Central Union Telephone Company to set one pole on the south side of alley between Grace and Huron Street and Meade and Olive Street Communication received from Joseph P. Pink, Clerk of the Board of Public Works of Indianapolis, Indiana in regard to record book for ale ctric lights. Same read and placed on file. Mr. Crabill informed the Boa d that the reason the Gr^_nd Trunk and e Western Ry. Company had not replan heir crossings in this city was due to not being able to get suitable crossing plank, but would give this their immediate attelition as soon as new planking arrived. STREET OR AiLEY IMPROVEMENT RESOLUTION NO.. 407. BE IT RESOLVED BY THE BOARD Or PUBLIC WORKS OR THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY,STATE OF INDIANA, that it is desired and deemed necessary to improve Keasey Street from Michigan Street to Carroll Street as follows, to -wit: - By grading and paving the roadway, also by grading and paving the road- ways of all intersecting and entering streets and alleys lying within the property lines of slid Keasey Street not included in the roadway; by paving said roadways with either Asphalt, Asphaltic Concerte, Brick or Bitulithic laid on a five (5) pinch Portland Cement cuncrete foundation, or with brick laid on a six (6) inch rolled gravel foundation; by placing the necessary marginal cement curb; by curbing the roadway with cement curb where same is not already constructed; and by the construction of all necessary storm water inlets end conduits; all as shown on .the plans and in accordance with the profiles, detail drawl. -is and specifications on fie file in the office of the DepP.rtment of Public Works of the City of South Bend, Indiana. The cost of the improvement herein provided for_, except street and alley intersections , shall be paid by special assess-ent to be levied upon the property specially benefitted, to the amounts that the same maybe legally assessed therefor, in accordance with an Act of the General Assemble o the State of Indiana entitled "An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and purusant to the provisions of all acts amendatory and supplemental thereto.
