69S Board met in special session at 11*30 A. M. All members present. The Board allowed W. S. Benham to withdraw the sum -of $450.00 from the fund of, $1250.00 now on deposit in the St• Joseph Loan & Trust Oo, to pay for'labor,and repairs for the Stewart -Sheets Company made during the last week with connection with the Bowman CreeK Trunk sewer. The City Engineer submitted the list of property owners in the matter of the appropriation of certain property under Condemnation Resolution No. 371,1915 Beginning at the south east corner of lot 37 Original Flat of the Town of Lowell now a part of the City of South Bend, Indiana, thence west along the south line of said .lot 37 to the easterly line of the east race; thence south 16 feet; thence east par- llel with and 16 feet south of the south line of said lot 37 to the west line of Enerick Street; thence north along the west line of Enerick Street.16 feet to the place of beginning. Which list includes the names the owners and holdegrs of property and of interests therein sought to be taken*or beneficially or injuriously affected, and the description of the several pieces of property which is affected by the said appropriation proceedings. Thereupon the Board proceeded to award the damages sustained and to assess the benefits accruing to each piece of property upon said list. It was thereupon, upon motion duly made and seconded and unanimously adopted resolved that said list, together with the amounts of benefits and damges and net benefits and net damages therein set forther as to the several pareels of land be adopted and that the respective amount of bbaefits contained in said list be and are hereby assessed against the several tracts of land as specially set forth 'n said list, and that the respective amounts of damages contained in the said ,list be and are hereby awarded to the several tracts of lend as sp e6ifically set forth in said list, and that the net benefits or net damages, as the case may be as- toA.the respec- tive tracts of land, contained in said list are hereby awarded or assessed, as hhe case may be as to the said several tracts of land. The Board hereby further sets off the benefits and damages each against the other where both benefits and damages are assessed against the same piece of property, tract of land or interest, and hereby fixes said respective net benefits as the amount bhat dhall be paid by the respective owners as benefits, and further hereby fixes the respective net damages as to the several tracts as the amount that shall be paid to the owners of the respective tracts as damages. Thereupon, upo n motion duly mad and seconded and unanimously adopted, they 6th. day of July,1915 was fixed as the day at 7:45 P-M. on which this Board will recive or hear remonstrances from persons with regard to the amount of their respec- tive awards or assessments, and the Clerk of this Board was instructed to prepare and cause to be duly and legally given, notices to the owners of each parcel of property, showing the amount of the assessment or award, with s description of the property affected, and the date of said hearing.
