WHEREAS, the Commission submitted its Resolution No. 1138 to the <br />Area Plan Commission of St. Joseph County for approval pursuant to <br />the provisions of Indiana Code 36- 7- 14 -16; and <br />WHEREAS, the Area Plan Commision of St. Joseph County at its <br />regular meeting March 16, 1993, approved its Resolution No. 116 -93, <br />which Resolution constituted the written.order of the Area Plan <br />Commission of St. Joseph County approving Resolution No. 1.138 as it <br />pertains to the Development Plan for the Area pursuant to IC <br />36- 7- 14 -16; and <br />WHEREAS, the Commission. submitted to the South Bend Common <br />Council, legislative body for the City of South Bend, St. Joseph <br />County, Indiana, Resolution No. 116 -93 of the Area Plan Commission of <br />St. Joseph County, constituting the Area Plan Commission's written <br />order approving Resolution No. 1138 and its certification that <br />Resolution No. 1138 as it pertains to the Development Plan conforms <br />to the master plan of development for the City of South Bend; and <br />WHEREAS, the South Bend Common Council, at its regular meeting, <br />March 22, 1993, adopted its Resolution No. 2026 -93 approving the <br />order of the Area Plan Commission of St. Joseph County with regard to <br />the base assessment date change for property within the Area; and <br />WHEREAS, after receipt of the written order of approval of the <br />Area Plan Commission of St. Joseph County, Indiana, and approval of <br />the South Bend Common Council, the Commission caused to be published <br />,► notice of the adoption and substance of Resolution No. 1138, in <br />accordance with IC 5 -3 -1, with such notice also stating that maps and <br />plats have been preparedd and can be inspected at the office of the <br />Redevelopment Department and naming May 7, 1993, at 10:00 a.m., at <br />1308 County -City Bldg., South Bend, Indiana, as the date, time, and <br />alley; thence South along the centerline of said <br />alley to the intersection of the centerline of the <br />first East -West 16.5 foot alley; thence East along <br />the centerline of said alley to the intersection of <br />� <br />the West right -of -way line of Studebaker Street; <br />thence North to the intersection of a projected <br />North right -of -way line of Hine Street; thence East <br />along the projected and North right -of -way line of <br />Hine Street to the intersection of the East <br />right -of -way line of Walnut Street; thence South <br />along the East right -of -way line of Walnut Street <br />to the intersection of the South property line of <br />the City Cemetery; thence East along the South <br />property line of said Cemetery to the intersection <br />of the East property line of said Cemetery; thence <br />North along the East property line of said Cemetery <br />to a point approximately 39.0 feet North of the <br />Northwest Corner of Lot 6 of Kuespert & Sommer's <br />z <br />Addition (now noted as Block W44- Parcel 7); thence <br />Northeasterly along a projected line and parallel <br />with the Northwesterly line of Kuespert & Sommer's <br />_ <br />Addition to the intersection of the centerline of <br />LaPorte Avenue; thence Northwesterly along the <br />centerline of LaPorte Avenue to the intersection of <br />the projected centerline of the first 14.0 foot <br />East -West alley lying North of LaSalle Court; <br />thence East along the centerline of said alley to <br />the intersection of the West property line of Lot <br />g <br />1, part of the original Lot 1 of Chapin's <br />Subdivision of bank outlots 1 and 2; thence South <br />along the West property line of said Lot 1 to the <br />Northwest corner of Lot 3 of Horatio Chapin <br />Subdivision (now noted as Block W52- Parcel 6); <br />thence Southeasterly along the North property line <br />of Lots 3, 5, 7, 9 and 11 (now noted as Block <br />W52 - Parcels 6, 7, 8, 9 and 10) to the intersection <br />of the centerline of William Street;
