h. Reimburse the City for rentals paid by it for a <br />building or parking facility in or serving the allocation <br />area under any lease entered into under I.C. 36 -1 -10; <br />i. Pay all or a portion of the property tax replacement <br />credit to taxpayers in an allocation area as determined by <br />the Commission, in the amount determined in the manner <br />provided in I.C. 36- 7- 14- 39(b)(2)(I); <br />j. Pay expenses incurred by the Commission for local <br />public improvements that are in the allocation area or <br />serving the allocation area. Public improvements include <br />buildings, parking facilities, and other items described in. <br />I.C. 26- 7- 14- 2.5.1(a); <br />k. Reimburse public and private entities for expenses <br />incurred in training employees of industrial facilities that <br />are located (1) in the allocation area and (2) on a parcel <br />of real estate that has been classified as. industrial <br />property under the rules of the state board of tax <br />commissioners, all as provided in I.C. 36- 7- 14- 39(b)(2)(K): <br />Provided, however, that if future uses of property tax proceeds <br />allocated to the Special Fund are authorized or permitted by <br />amendment to the Act, including I.G. 36- 7- 14 -39, after the effective <br />date of this Resolution, those uses shall also be authorized-or <br />permitted for property tax proceeds allocated to the Special Fund. <br />21. Inasmuch as a portion of the Sample -Ewing Allocation Area <br />(South Bend.Allocation Area No. 8) is located within an Enterprise <br />Zone created under I.C. 4- 4 -6.1, when the money in the Special Fund <br />is sufficient to pay when.due all,principal of and interest on bonds <br />described in subdivisions-a, c, and d of paragraph 20, above, and is <br />not needed for the purposes described in subdivisions b and d of <br />paragraph. 20, above, or as permitted.by amendments to the Act, <br />including I.C. 36- 7- 14 -39, the excess in this Special Fund shall be <br />paid into the Sample -Ewing Enterprise Zone Fund for use as permitted <br />by I.C. 36- 7- 14- 39(g). <br />22. When funds are no longer needed for purposes permitted in <br />paragraphs 20 and 21, above, money in the Special. Fund in excess of <br />that amount shall be paid to the respective taxing units in the <br />manner described by I.C. 36- 7- 14- 39(b)(1). <br />23. The Secretary is directed to file certified copies of this <br />Resolution with the St. Joseph County Auditor and Portage Township <br />Assessor. <br />24. Pursuant to I.C. 36- 7- 14- 17(c), the Secretary is directed to <br />file with officers authorized to fix budgets, tax rates, and tax <br />levies under I.G. 6- 1.1 -17 -5, of each taxing unit that is wholly or <br />partly within the Sample. -Ewing Allocation Area (South Bend Allocation <br />Area No. 8), described at Paragraph 15, above: <br />(1) A copy of the notice of the adoption and substance of this <br />resolution, and <br />(2) A statement disclosing the impact. of the Sample -Ewing <br />Allocation Area (South Bend Allocation Area No. 8) including: <br />(A) The estimated economic benefits and costs incurred by <br />the allocation area, as measured.by increased employment and <br />anticipated growth of real. property assessed values., and <br />(B) The anticipated impact on tax revenues of each taxing <br />unit. <br />25. The United States and HUD are assured of full compliance by <br />the Commission with the Department of HUD regulations.effectuating <br />Title VI of the Civil Rights Act of 1964, as amended. <br />-26- <br />
