WHEREAS, Section 27.5 of the Act provides for the means for
<br />amending a resolution or plan; and
<br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
<br />Commission, governing body of the City of South Bend, Department of
<br />Redevelopment, as follows:
<br />1. Resolution No. 818, as amended, is hereby further amended by
<br />changing the base assessment date for the West Washington- Chapin
<br />Allocation Area (South Bend Allocation Area No. 7 ), as expanded, from
<br />March 1, 1987, to March 1, 1992. Any property taxes subsequently
<br />levied by or for the benefit of any public body entitled to a
<br />distribution of property taxes on taxable property in the Allocation
<br />Area, as expanded, shall be allocated., distributed and used as
<br />provided in Resolution No. 818, as amended, and the Act, as the same.
<br />may be amended from time to time.
<br />2. The Commission. finds that the proposed amendment to
<br />Resolution No. 81.8, as amended., is reasonable and appropriate when
<br />considered in relation to the Development Plan and to Resolution No.
<br />818, as amended, respectively, and the purposes_ of the.Act.
<br />3. The Commission finds that this proposed amendment to
<br />Resolution No. 818, as amended, conforms to the comprehensive plan of
<br />the City.
<br />4. All other findings, determinations, and conc.lusions.in
<br />Resolution No. 818, as amended, shall remain as stated therein.
<br />5. The secretary is hereby directed to submit a certified copy
<br />of this resolution to the Area Plan Commission of St. Joseph.County
<br />and the Common Council of the City of South. Bend, as provided in I.C.
<br />36- 7- 14 -16, for the approval and, if approved by both bodies, the
<br />same shall be submitted to public hearing and remonstrance as
<br />provided by I.C. 36- 7- 14 -17, after public notice in accordance with
<br />I.C. 36- 7 -14 -17 and I.C. 5 -3 -1.
<br />6. This Resolution does not affect any rights or liabilities
<br />accrued, penalties incurred, offenses committed, or proceedings begun
<br />before the effective date of this Resolution. Those rights,
<br />liabilities and proceedings continue and shall be imposed and
<br />enforced under superceded resolution as if this resolution had not
<br />been enacted.
<br />7. The United States. of America is hereby assured of full .
<br />CW compliance by the South Bend Redevelopment Commission with
<br />regulations of the Department of Housing and Urban Development
<br />effectuating Title VI of the Civil. Rights Act of 1964, as amended.
