21. Inasmuch as a portion of the Sample -Ewing Allocation <br />Area (South Bend Allocation Area No. 8) is located within an <br />Enterprise Zone created under I.C. 4- 4 -6.1, when the money in <br />the Special Fund is sufficient to pay when due all principal <br />of and interest on bonds described in subdivisions a, c, and <br />d of paragraph 20, above, and is not needed for the purposes <br />described in subdivisions b and d of paragraph 20, above, or <br />as permitted by amendments to the Act, including I.C. <br />36- 7- 14 -39, the excess in this Special Fund shall be paid <br />into the Sample -Ewing Enterprise Zone Fund for use as <br />permitted by I.C. 36- 7- 14- 39(g). <br />22. When funds are no longer needed for purposes <br />permitted in paragraphs 20 and 21, above, money in the <br />Special Fund in excess of that amount shall be paid to the <br />respective taxing units in the manner described by I.C. <br />36- 7- 14- 39(b)(1). <br />23. The Secretary is directed to file certified copies <br />of this Resolution with the St. Joseph County Auditor and <br />Portage Township Assessor. <br />24. Pursuant to I.C. 36- 7- 14- 17(c), the Secretary is <br />directed to file with officers authorized to fix budgets, tax <br />rates, and tax levies under I.C. 6- 1.1 -17 -5, of each taxing <br />unit that is wholly or partly within the Sample -Ewing <br />Allocation Area (South Bend Allocation Area No. 8), described <br />at Paragraph 15, above: <br />(1) A copy of the notice of the adoption and substance of <br />this resolution, and <br />(2) A statement disclosing the impact of the <br />Sample -Ewing Allocation Area (South Bend Allocation Area <br />No. 8) including: <br />(A) The estimated economic benefits and costs <br />incurred by the allocation area, as measured by <br />increased employment and anticipated growth of real <br />property assessed values, and <br />(B) The anticipated impact on tax revenues of each <br />taxing unit. <br />25. The United States and HUD are assured of full <br />compliance by the Commission with the Department of HUD <br />regulations effectuating Title VI of the Civil Rights Act of <br />1964, as amended. <br />26. This Resolution, together with supporting data, <br />shall be submitted to the Area Plan Commission of St. Joseph <br />County and the Common Council of South Bend, as provided by <br />I.C. 36- 7- 14 -16, for their approval of the Resolution and <br />Plan, and if approved by both bodies, the Resolution and Plan <br />shall be submitted to public hearing and remonstrance as <br />provided by I.C. 36- 7- 14 -17, after public notice in <br />accordance with I.C. 36- 7 -14 -17 and I.C. 5 -3 -1. <br />27. Resolution No. 1151, adopted April 16, 1993, <br />Resolution 1154, adopted May 21, 1993, and Resolution No. <br />1993, adopted October 1, 1993, by the South Bend <br />Redevelopment Commission are hereby superceded by the <br />adoption of this Resolution 1207: Provided, however, that all <br />actions taken pursuant thereto are hereby ratified. <br />28. All other orders or resolutions in conflict herewith <br />are hereby rescinded, revoked, and repealed insofar as such <br />conflict exists. <br />29. This Resolution does not affect any rights or <br />liabilities. accrued, penalties incurred, offense committed, <br />or proceedings begun before the effective date of this <br />-26- <br />
