RESOLUTION 1219 RESOLUTION RELATING TO THE ACQUISITION OF REAL PROPERTY IN THE SOUTH BEND CENTRAL DEVELOPMENT AREA WHEREAS, it is deemed necessary and desirable by the South Bend Redevelopment Commission, in furtherance of the South Bend Central Development Area Redevelopment Plan, to acquire unencumbered fee title to the real property identified at Attachment "A," hereto, which real property is located in the South Bend Central Development Area in the City of South Bend., Indiana. NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: 1. The Executive Director is authorized and directed to cause a notice and written offer to be made to the owner(s) of real property identified at Attachment "A," hereto (Real Estate), to purchase the Real Estate under the following conditions: A. The offering price shall be that amount specified at Attachment "A," hereto, which amount does not exceed the average of two (2) appraisals of the Real Estate procured or adopted by the South Bend Redevelopment Commission (Commission). B. Payment of the purchase price shall be made to the owner(s) over a period of three (3) years, and shall be made subject to annual, appropriation of the appropriate fiscal body. C. The offer shall be made subject to the results of a Phase I environmental audit of the Real Estate, performed and paid for by the Commission, which results must meet with the Commission's approval. Said offer shall also extend to the owner(s) an invitation to discuss with the Commission its desire to acquire the Real Estate. Adopted at the Regular Meeting of the South Bend Redevelopment Commission held on January 21, 1994, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, IN 46601.
