Resolution No. 1212 fW1 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend (the "City ") is the owner of the certain real property situated in St. Joseph County, Indiana and being more particularly described at Exhibit "A," hereto (hereinafter referred to as the "Real Property "); and WHEREAS, the City of South Bend, Department of Redevelopment (Redevelopment), acting by and through the South Bend Redevelopment Commission ( "Commission "), hereby expresses its desire to acquire Real Property from the City; and WHEREAS, the City is desirous of transferring the Real Property to Redevelopment; and WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend (the "Board ") has custody of and may maintain all real property of the City of South Bend; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend, acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and more particularly described at Exhibit "A," hereto, by the City of South Bend to the City of South Bend, Department of Redevelopment shall be, and hereby is, accepted, subject to the adoption of a resolution by the Board of Public Works of the City of South Bend, substantially identical in its terms and conditions as this resolution. 2. That upon receipt of fully executed quitclaim deeds to the Real Property from the City, the Director of Redevelopment is hereby authorized and directed to cause the recording of said quitclaim deeds in the Office of the St. Joseph County Recorder. 3. That this Resolution shall be in full force and effect upon its adoption.
