REGULAR MEETING SEPTEMBER 12, 2011 <br /> <br /> <br /> <br />Ms. Nayder advised that the proposed bill was initiated by the Area Plan Commission. <br />The purpose of this bill is to correct a number of scriveners erros in the recently adopted <br />Ordinance No. 10094-11, and to include the ability for residential structures that are non- <br />conforming in industrial districts, to add and/or expand accessory structures to the same <br />development standards as is allowed in residential districts. <br /> <br />This being the time heretofore set for the public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill. Councilmember Oliver Davis <br />seconded the motion which carried by a voice vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 56-11 PUBLIC HEARING ON A BILL FIXING <br />SALARIES AND WAGES OF APPOINTED <br />OFFICERS AND NON-BARGAINING <br />EMPLOYEES OF THE CITY OF SOUTH BEND, <br />INDIANA, FOR THE CALENDAR YEAR 2012 <br /> <br />Councilmember Dieter made a motion to continue this bill until September 26, 2011 <br />meeting of the Council at the request of the petitioner. Councilmember Oliver Davis <br />seconded the motion which carried by a voice vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 50-11 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND TO TRANSFER A PORTION OF <br />FREDRICKSON PARK FROM THE BOARD OF <br />PARK COMMISSIONERS TO THE STATE OF <br />INDIANA AND TO RESCIND ORDINANCE <br />10079-11 <br /> <br />Councilmember Puzzello, Chairperson, PARCS Committee, reported that this committee <br />held a Public Hearing on this bill this afternoon and voted to send it to the full Council <br />with a favorable consideration. <br /> <br />th <br />Mr. Tom Bodnar, Assistant City Attorney, 14 Floor County-City Building, 227 W. <br />Jefferson Blvd., South Bend, Indiana, made the presentation for this bill. <br /> <br />Mr. Bodnar advised that on March 24, 2011 the South Bend Common Council passed <br />Ordinance No. 10079-11, which provided for the transfer of 0.086 acres of the <br />northwesterly portion of Frederickson Park to the Indiana Department of Transportation <br />in accordance with the Uniform Property or Easement Acquisition Offer made by that <br />department. Since the, the Indiana Department of Transportation has rescinded that offer <br />and made a new offer to purchase 0.037 acres from the northwesterly portion of <br />Frederickson Park. Mr. Bodnar advised that the South Bend Board of Park <br />Commissioners recommended this offer be accepted. Mr. Bodnar noted that the <br />Common Council under I.C. 36-10-4-18, has the authority to authorize the sale of Park <br />land. <br /> <br />This being the time heretofore set for the public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill.
