Resolution No. 1314 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM ST. JOSEPH COUNTY, INDIANA WHEREAS, St. Joseph County, Indiana (the "County ") is the owner of the certain real property situated in St. Joseph County, Indiana and being more particularly described at Exhibit "A," hereto (hereinafter referred to as the "Real Property "); and WHEREAS, the City of South Bend, Department of Redevelopment (Redevelopment), acting by and through the South Bend Redevelopment Commission ( "Commission "), hereby expresses its desire to acquire Real Property from the City; and WHEREAS, the County is desirous of transferring the Real Property to Redevelopment; and WHEREAS, pursuant to I.C. 36- 2 -2 -20, the Board of Commissioners of St. Joseph County, Indiana (the "Board ") has custody of and may maintain all real property of St. Joseph County; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, County, acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and more particularly described at Exhibit "A," hereto, by St. Joseph County, Indiana to the City of South Bend, Department of Redevelopment shall be, and hereby is, accepted, subject to the adoption of a resolution by the Board of Commissioners of St. Joseph County, substantially identical in its terms and conditions as this resolution. 2. That in consideration of the transfer of the Real Property by St. Joseph County, Indiana to the City of South Bend, Department of Redevelopment, the City of South Bend, Department of Redevelopment agrees to pay to St. Joseph County the sum of $1.00 each for the transfer of Parcels I and II of the Real Estate, and the sum of $5,000.00 for the transfer of Parcel III of the Real Estate, such payment to be made upon conveyance of said Real Estate. 3. That upon receipt of fully executed quitclaim deed(s) to the Real Property from the City, the Director of Redevelopment is hereby authorized and directed to cause the recording of said quitclaim deed(s) in the Office of the St. Joseph County Recorder.
