Resolution No. 1322 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY TO THE CITY OF SOUTH BEND WHEREAS, the real property generally described as follows and situated in St. Joseph County, Indiana, is owned by the City of South Bend, Indiana, for the use and benefit of its Department of Redevelopment: A part of the northeast quarter of Section 11, Township 37 North, Range 2 East, Portage Township, City of South Bend, St. Joseph County, Indiana, described as follows: Lots Numbered 7, 8, and 9 as shown on the recorded Plat of Frederick J. Thomas' Subdivision of the south part of Bank Out Lot Numbered 74 of the First Plat of Out Lots of the Town, now City of South Bend, platted by the State Bank of Indiana, recorded April 27, 1860 in Plat Book 1, page 56 (hereinafter the Real Property); and WHEREAS, the South Bend Redevelopment Commission (the Commission) is the governing body of the City of South Bend, Department of Redevelopment, pursuant to I.C. 36- 7 -14 -3; and WHEREAS, the Commission, is desires to transfer the Real Property to the City of South Bend, Indiana; and WHEREAS, the City of South Bend is desirous of acquiring the Real Property from the Commission; and WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend (the "Board ") has custody of and may maintain all real property of the City of South Bend; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend, acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Redevelopment, acting through the Commission, and pursuant to I.C. 36- 7- 14- 12.2(a)(3), may exchange or transfer property with another governmental entity upon terms and conditions agreed upon Ic'; by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Commission desires to transfer the Real Property to the City of South Bend, and the City of South Bend, acting by and through the Board, has agreed to accept the transfer of the Real Property from the Commission for the payment of a nominal consideration.
