Resolution No. 1322 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT <br />COMMISSION APPROVING THE TRANSFER OF REAL PROPERTY <br />TO THE CITY OF SOUTH BEND <br />WHEREAS, the real property generally described as <br />follows and situated in St. Joseph County, Indiana, is owned <br />by the City of South Bend, Indiana, for the use and benefit of <br />its Department of Redevelopment: <br />A part of the northeast quarter of Section 11, <br />Township 37 North, Range 2 East, Portage Township, <br />City of South Bend, St. Joseph County, Indiana, <br />described as follows: Lots Numbered 7, 8, and 9 as <br />shown on the recorded Plat of Frederick J. Thomas' <br />Subdivision of the south part of Bank Out Lot <br />Numbered 74 of the First Plat of Out Lots of the <br />Town, now City of South Bend, platted by the State <br />Bank of Indiana, recorded April 27, 1860 in Plat Book <br />1, page 56 (hereinafter the Real Property); <br />and <br />WHEREAS, the South Bend Redevelopment Commission (the Commission) <br />is the governing body of the City of South Bend, Department of <br />Redevelopment, pursuant to I.C. 36- 7 -14 -3; and <br />WHEREAS, the Commission, is desires to transfer the Real Property <br />to the City of South Bend, Indiana; and <br />WHEREAS, the City of South Bend is desirous of acquiring the Real <br />Property from the Commission; and <br />WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of <br />the City of South Bend (the "Board ") has custody of and may maintain <br />all real property of the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend, <br />acting by and through the Board, may exchange or transfer property <br />with another governmental entity upon terms and conditions agreed upon <br />by the two (2) entities as evidenced by the adoption of substantially <br />identical resolutions of each entity; and <br />WHEREAS, the Redevelopment, acting through the Commission, and <br />pursuant to I.C. 36- 7- 14- 12.2(a)(3), may exchange or transfer property <br />with another governmental entity upon terms and conditions agreed upon <br />Ic'; by the two (2) entities as evidenced by the adoption of substantially <br />identical resolutions of each entity; and <br />WHEREAS, the Commission desires to transfer the Real Property to the <br />City of South Bend, and the City of South Bend, acting by and through the <br />Board, has agreed to accept the transfer of the Real Property from the <br />Commission for the payment of a nominal consideration. <br />
