3.2 Information available to the OWNER and required by the CONSULTANT shall be <br />furnished at no cost to the CONSULTANT in an expeditious manner for the <br />orderly progress of the work. The CONSULTANT shall be entitled to rely upon <br />the accuracy thereof. <br />3.3 The OWNER, pursuant to Article 1.2 hereof, shall have complete authority to <br />transmit instructions to and receive information from the CONSULTANT. <br />3.4 The CONSULTANT is responsible for the professional quality, technical <br />accuracy, timely completion and coordination of all designs, drawings, <br />specifications, reports, and other services furnished by the CONSULTANT under <br />this Agreement consistent with reasonable, prudent and professional skill and <br />care as is ordinarily exercised by consultants in similar circumstances and <br />locations. The CONSULTANT shall, without additional compensation, correct or <br />revise any errors, omissions or other deficiencies in its design, drawings, <br />specifications reports and other services; provided, that in the case of an <br />omission, CONSULTANT shall be responsible only for the additional cost, if any, <br />compared with what the cost of work would have been, had it been included in <br />the initial product of services. <br />3.5 Both parties agree that for the purpose of this Agreement, the CONSULTANT <br />shall be an independent contractor and not the employee of the OWNER. <br />3.6 The CONSULTANT shall not have control over and shall not be responsible for <br />the acts or omissions of any contractor, engineer, consultant or other person <br />engaged separately and directly by the OWNER. <br />ARTICLE 4. ASSURANCES <br />41 Non - Discrimination. The CONSULTANT, with regard to the work performed by it <br />during this Agreement, shall not discriminate on the grounds of sex, race, color, <br />national origin, handicap or veteran status in the selection and retention of sub- <br />contractors, including procurement of materials and leases of equipment. This <br />Agreement incorporates by reference the equal opportunity clause set forth in <br />Section 202 of Executive Order 11246. <br />4.2 Solicitations for Sub - Contracts. Including Procurements of Materials and <br />Equipment. In all solicitations, either by competitive bidding or negotiation, made <br />by the CONSULTANT for work to be performed under a sub - contract including <br />procurement of materials or lease of equipment, each potential subcontractor or <br />supplier shall be notified by the CONSULTANT of its obligations under this <br />Agreement and the regulations relative to non- discrimination on the grounds of <br />sex, race, color, national origin, handicap or veteran status. <br />4.3 Ownership and Reuse of Documents. The drawings and specifications are <br />instruments of service; and as such, the documents, tracings, and field notes <br />originating with the CONSULTANT are and remain the property of the <br />CONSULTANT whether the work for which they were prepared is executed or <br />Page 3 of 6 <br />
