Resolution No. <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />APPROVING THE TRANSFER OF REAL PROPERTY <br />TO THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the City of South Bend, Indiana, Department of <br />Redevelopment (Redevelopment) is the owner of the following <br />described real property situated in St. Joseph County, Indiana: <br />That part of the Northeast Quarter of Section <br />13, Township 37 North, Range Two East, City of <br />South Bend, St. Joseph County, Indiana, which <br />is described as: Beginning at a point on the <br />North line of Keasey Street which is South 89 <br />degrees 38 minutes 03 seconds East, 35.00 feet <br />from the Southwest corner of Lot 99 as shown <br />on the recorded Plat of "Wenger & Krieghbaum's <br />1st Addition;" thence North 1 degree 03 <br />minutes 32 seconds East, 606.33 feet to a 5/8" <br />capped rebar set on the South line of Sample <br />Street which is South 89 degrees 10 minutes <br />03 seconds East, 35.00 feet from the Northwest <br />corner of Lot 1 as shown on said recorded <br />Plat; thence South 89 degrees 10 minutes 03 <br />seconds East, 213.55 feet; thence South 56 <br />degrees 06 minutes 12 seconds East, 177.69 <br />feet; thence South 60 degrees 49 minutes 39 <br />seconds East, 54.83 feet; thence South 56 <br />degrees 50 minutes 24 seconds East, 279.71 <br />feet; thence South 57 degrees 10 minutes 37 <br />seconds East 207.90 feet; thence South 00 <br />degrees 12 minutes 10 seconds West, 216.90 <br />feet; thence North 89 degrees 38 minutes 03 <br />seconds West, 828.22 feet to the Point of <br />Beginning. Containing 8.73 acres <br />(hereinafter referred to as the Real Property), and; <br />WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend <br />Redevelopment Commission (Commission) is the governing body of the <br />City of South Bend, Department of Redevelopment and, pursuant to <br />I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and <br />WHEREAS, Redevelopment, through the Commission, is desirous of <br />transferring the Real Property to the City of South Bend, Indiana, <br />with the understanding that the City of South Bend, Indiana, <br />through its Board of Public Works, will subsequently dispose of <br />the Real Property to the Family & Children's Center Properties <br />Management, Inc., an Indiana non - profit corporation, exempt from <br />income taxation under Section 503(c) of the Internal Revenue Code, <br />
