i Resolution No. A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana (the "City ") is the owner of the following described real property situated in St. Joseph County, Indiana: Lot Numbered One Hundred Twenty -six (126) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City of South Bend, St. Joseph County, Indiana recorded June 17, 1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, page 21. Key No. 18- 7023 -0913 (hereinafter referred to as the Real Property) and; WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend (the "Board ") has custody of and may maintain all real property of the City of South Bend; and WHEREAS, the City, through the Board, desires to transfer the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment for use in the redevelopment of the Sample -Ewing Development Area; and WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through its governing body, the South Bend Redevelopment Commission desires to acquire the Real Property from the City of South Bend; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Board of Publi ;Works, at its meeting of May 28, 1996 adopted its Resolution No. approving the transfer of the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally described as follows:
