WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and
<br />through the Board, may exchange or transfer property with another
<br />governmental entity upon terms and conditions agreed upon by the
<br />"aw two (2) entities as evidenced by the adoption of substantially
<br />identical resolutions of each entity; and
<br />WHEREAS, the Board of Public Works, at its meeting of ,
<br />1997 adopted its Resolution No. , approving the transfer
<br />of the Real Property to the City of South Bend, for the use and
<br />benefit of its Department of Redevelopment.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
<br />REDEVELOPMENT COMMISSION AS FOLLOWS:
<br />1. That the transfer of the Real Property situated in St.
<br />Joseph County, Indiana, and generally described as follows:
<br />Lot Numbered Forty -four (44) as shown on the
<br />recorded Plat of Martin L. Wenger's Third
<br />Addition to the City of South Bend, dated
<br />December 12, 1887, and recorded December 12,
<br />1887, in the Office of the Recorder of St. Joseph
<br />County, Indiana, in Plat Book 5, page 2,
<br />EXCEPTING THEREFROM the South 5 feet thereof for
<br />the widening of Wenger Street;
<br />Lot Numbered Forty -six (46) as shown on the
<br />recorded Plat of Martin L. Wenger's Third
<br />Addition to the City of South Bend, dated
<br />December 12, 1887, and recorded December 12,
<br />1887, in the Office of the Recorder of St. Joseph
<br />County, Indiana, in Plat Book 5, page 2;
<br />and
<br />Lot Numbered Forty -eight (48) as shown on the
<br />recorded Plat of Wenger's Third Addition to the
<br />City of South Bend, dated December 12, 1887, and
<br />recorded December 12, 1887, in the Office of the
<br />Recorder of St. Joseph County, Indiana, in Plat
<br />Book 5, page 2,
<br />by the City of South Bend, Indiana to the City of South Bend, for
<br />the use and benefit of its Department of Redevelopment, shall be,
<br />and hereby is, accepted.
<br />2. That the Director of Redevelopment for the City of South
<br />Bend shall cause the recording of the quitclaim deed conveying all
<br />of the right, title and interest of the City of South Bend, Indiana
<br />in and to the Real Property to the City of South Bend, for the use
<br />and benefit of its Department of Redevelopment.
