J61 It I-- - Resolution No. 1636 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana (the "City ") has or may have an interest in the following described real property situated in St. Joseph County, Indiana: See attached Exhibit A (hereinafter referred to as the Real Property); and WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend (the "Board ") has custody of and may maintain all real property of the City of South Bend; and WHEREAS, the City, through the Board, desires to transfer its interest in the Real Property, if any, to the City of South Bend, for the use and benefit of its Department of Redevelopment for subsequent transfer to St. Joseph County, Indiana for use in the construction of the new County Jail; and WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through its governing body, the South Bend Redevelopment Commission desires to acquire the Real Property from the City of South Bend; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Board of Public Works, at its meeting of R-a4, 1998 adopted its Resolution No. _ , approving the transfer of the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment.
