J61 <br />It I-- - <br />Resolution No. 1636 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />ACCEPTING THE TRANSFER OF REAL PROPERTY <br />FROM THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the City of South Bend, Indiana (the "City ") has or <br />may have an interest in the following described real property <br />situated in St. Joseph County, Indiana: <br />See attached Exhibit A <br />(hereinafter referred to as the Real Property); and <br />WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works <br />of the City of South Bend (the "Board ") has custody of and may <br />maintain all real property of the City of South Bend; and <br />WHEREAS, the City, through the Board, desires to transfer its <br />interest in the Real Property, if any, to the City of South Bend, <br />for the use and benefit of its Department of Redevelopment for <br />subsequent transfer to St. Joseph County, Indiana for use in the <br />construction of the new County Jail; and <br />WHEREAS, the City of South Bend, Department of Redevelopment, <br />acting by and through its governing body, the South Bend <br />Redevelopment Commission desires to acquire the Real Property from <br />the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and <br />through the Board, may exchange or transfer property with another <br />governmental entity upon terms and conditions agreed upon by the <br />two (2) entities as evidenced by the adoption of substantially <br />identical resolutions of each entity; and <br />WHEREAS, the Board of Public Works, at its meeting of R-a4, <br />1998 adopted its Resolution No. _ , approving the transfer <br />of the Real Property to the City of South Bend, for the use and <br />benefit of its Department of Redevelopment. <br />
