No. 1737 expanding the boundaries of the SBCDA, establishing an allocation area for the purposes of TIF and amending the SBCDA development plan

Bend Central Development Area, and has supplemented the maps and plats of said area and has caused to be prepared maps and plats of an additional blighted area immediately adjacent to the South Bend Central Development Area hereinafter referred to as "Expansion Are No. 4 ", said maps and plats of the South Bend Central Development Area and Expansion Area No. 4 show the boundaries of said areas, the location of the various parcels of property, streets, alleys and other features affecting the acquisition, clearance, replatting, replanning, rezoning or redevelopment of said areas and part of the areas that are to be devoted to public ways, levees, sewerage, parks, playgrounds and other public purposes under the plan for the redevelopment of the South Bend Central Development Area and Expansion Area No. 4 as adopted herein, which said Expansion Area No. 4 is more particularly described as follows: Expansion Area No. 4 A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows: Beginning at the intersection of the North right -of -way line of La Salle Avenue and the West right -of -way line of Lafayette Boulevard; thence North along the said West right -of -way line to the North right -of -way line of Park Lane projected West; thence East along said projected right- .. of -way line and the North right -of -way line of Park Lane to the East right -of -way line of Michigan Street; thence South along said East right -of -way line to the North right -of -way line of Bartlett Street; thence East along said North right -of -way line to the East right -of -way line of St. Joseph Street projected North; thence South along said projected line and the East right -of -way line of St. Joseph Street to the North right -of -way line of Marion Street; thence East along the said North right -of -way line and its projection to the East to the centerline of the St. Joseph River; thence Southwesterly along said centerline of the St. Joseph River to the South right -of- way line of Madison Street projected to the East; thence West along said projected line and the South right -of -way line of Madison Street to the West right -of -way line of Michigan Street; thence South along said West right -of -way line to the North right -of -way line of La Salle Avenue; thence West along said North right -of -way line of La Salle Avenue to the place of beginning containing 78.15 acres; and WHEREAS, the Commission desires to further amend Resolution No. 737 by expanding the South Bend Central Development Area to include Expansion Area No. 4 (the South Bend Central Development Area and Expansion Area No. 4 are collectively referred to hereinafter as the "Area ") so as to facilitate and enhance the replanning, redevelopment and disposition of property within the Area: and WHEREAS, Section 39 of the Act permits the creation of an allocation area within a blighted area to provide for the allocation and distribution, as provided by the Act, of the proceeds of taxes levied on property situated in the allocation area; and WHEREAS, the Commission in accordance with the Act, has previously established the South Bend Central Allocation Area (South Bend Allocation Area No. 1 A); and WHEREAS, the Commission, in accordance with the Act, expanded the boundaries of the South Bend Central Allocation Area (South Bend Allocation Area No. 1 A) to include Expansion Area No. I by the adoption of Resolution No. 834, adopted on March 11, 1988, and confirmed by Resolution No. 836, adopted on April 15, 1988 and to include Expansion Area No. 2 and Expansion Area No. 3 by the adoption of Resolution No. 893, adopted on October 27, 1989 and said expanded Area was designated the South Bend Central Allocation Area (South Bend Allocation Area No. 1 A); and WHEREAS, the Commission now desires to establish a new Allocation Area to consist of the area located in Expansion Area No. 4; and WHEREAS, Section 17.5 of the Act provides for the means for amending a resolution or plan in a way that enlarges the boundaries of a redevelopment area by not more than twenty percent (20 %) of the original redevelopment area; and WHEREAS, there was presented to this meeting of the Commission for its consideration and approval a proposed amendment to the Development Plan ( "Amendment to South Bend Central Development Area Development Plan, Expansion Area No. 4, Downtown Medical Services District ", attached herein as "Exhibit A ") setting out the boundaries of the Area and identifying the types of redevelopment projects and purposes to be undertaken in the Area, which Development Plan is entitled: 3
