IL Resolution No.2070 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />ACCEPTING THE TRANSFER OF REAL PROPERTY <br />FROM THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the City of South Bend, Indiana (the "City") is the owner of the following <br />described real property situated in St. Joseph County, Indiana: <br />See attached Exhibit "A" <br />(collectively hereinafter referred to as the Real Property); and <br />WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South <br />Bend (the "Board ") has custody of and may maintain all real property of the City of South Bend; <br />and <br />WHEREAS, the City, through the Board, desires to transfer the Real Property to the City <br />of South Bend, for the use and benefit of its Department of Redevelopment for subsequent transfer <br />to the KSK - Scottsdale Mall, L.P. , a Delaware Limited Partnership, for use in the redevelopment <br />of the South Side Development Area; and <br />WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through <br />its governing body, the South Bend Redevelopment Commission desires to acquire the Real <br />Property ftom the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and through the Board, may <br />exchange or transfer property with another governmental entity upon terms and conditions agreed <br />upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of <br />each entity; and <br />WHEREAS, the Board of Public Works, at its meeting of June 28, 2004, adopted its <br />Resolution No. 28 -2004, approving the transfer of the Real Property to the City of South Bend, <br />for the use and benefit of its Department of Redevelopment. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT COMMISSION AS FOLLOWS: <br />1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and <br />generally described as follows: <br />See attached Exhibit " A" <br />
