' ' I "` RESOLUTION NO. 2061 A JOINT RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION AND CITY OF SOUTH BEND BOARD OF PUBLIC WORKS RATIFYING, CONFIRMING AND APPROVING CERTAIN ACTIONS PREVIOUSLY TAKEN RELATED TO THE STUDEBAKER NATIONAL MUSEUM RELOCATION PROJECT IN THE SOUTH BEND CENTRAL DEVELOPMENT AREA WHEREAS, the City of South Bend, Indiana ( "City ") has determined that the relocation of the Studebaker National Museum ( "Museum") to a site located within the City is in the best interests of the City and its citizens; and WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through its governing body, the South Bend Redevelopment Commission and the City of South Bend Board of Public Works desire to facilitate relocation of the Museum from its present location to a new facility located on a site adjacent to the Northern Indiana Center for History within the South Bend Central Development Area ( "Project "); and WHEREAS, relocation of the Museum will require a cooperative effort and a variety of actions to be taken by the South Bend Redevelopment Commission ( "Commission "), the City's Board of Public Works ( "BPW "), St. Joseph County, Indiana ( "County "), Studebaker National Museum, Inc. ( "SNM "), the Northern Indiana Center for History by and through the Northern Indiana Historical Society, Inc. ( "NIHS "), with assistance from South Bend Heritage Foundation ( "Heritage Foundation "); and WHEREAS, the afore -named entities have memorialized their intentions and understanding related to the Project in a Memorandum of Understanding dated February 2, 2004 and certain other documents incidental to and necessary for accomplishing the Project; and WHEREAS, pursuant to Indiana Code § 36- 4 -5 -3, the Mayor for the City of South Bend is empowered to sign contracts of the City; and WHEREAS, in order to facilitate the Project, the Mayor has heretofore executed certain documents on behalf of the City related to the Project pursuant to the authority granted by Indiana Code § 36- 4 -5 -3; and WHEREAS, the Commission and BPW each desire to ratify the MOU and the various actions taken to date related to the Project; NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: 1. The actions taken by the Mayor for the City of South Bend relating to the Project, IL including the execution of the MOU on behalf of the Commission and BPW are hereby in all respects ratified, confinned and approved.
