REGULAR MEETING OCTOBER 22, 2007 <br />Councilmember Kirsits, Chairperson, Zoning and Annexation Committee, reported that <br />this committee held a Public Hearing on this bill this afternoon and voted to send it to the <br />full Council with a favorable recommendation. <br />Mr. Charles Bulot, Assistant Zoning Administrator, Building, Department, 125 S. <br />Lafayette Blvd., Suite 100, South Bend, Indiana, presented the report from the Board of <br />Zoning Appeals. <br />Mr. Bulot advised that the petitioner is seeking a special exception for off site parking in <br />a Mixed Use "MU" District. He noted that the Board of Zoning Appeals held a public <br />hearing on September 20, 2007 and sends this bill to the Common Council with a <br />favorable recommendation. <br />Mr. Derek Spier, Urban Planner, Abonmarche, 750 Lincoln Way East, South Bend, <br />Indiana, made the presentation for this bill. <br />Mr. Spier advised that he is representing the petitioner Kendall-Weiss LLP which is a <br />Weiss Homes Development partnership. He stated that the purpose of petitioning for the <br />above special exception is to allow for additional parking spaces for the Weiss Homes <br />office site. A total of 30 parking spaces were required when the Final Site Plan was <br />approved for the Weiss Homes site in 1998. However, due to overall site constraints and <br />lot size, a variance was granted to allow for 20 spaces instead of the required 30 spaces. <br />The approval of this special exception will provide additional spaces which were <br />originally required in 1998. <br />A Public Hearing was held on the Resolution at this time. <br />There being no one present wishing to speak to the Council either in favor or in <br />opposition to this Resolution, Councilmember Dieter made a motion to adopt this <br />Resolution. Councilmember Varner seconded the motion which carried and the <br />Resolution was adopted by a roll vote of eight (8) ayes. <br />RESOLUTION NO. 3803-07 A RESOLUTION CONFIRMING THE <br />ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN <br />AREAS WITHIN THE CITY OF SOUTH BEND, <br />INDIANA, COMMONLY KNOWN AS 101 <br />SOUTH IOWA STREET AS A RESIDENTIALLY <br />DISTRESSED AREA FOR PURPOSES OF A <br />FIVE (5) YEAR RESIDENTIAL REAL <br />PROPERTY TAX ABATEMENT FOR <br />JONATHAN BURI~HOLDER <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has <br />adopted a Declaratory Resolution designating certain areas within the City as <br />Residentially Distressed Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known 101 <br />South Iowa Street, South Bend, Indiana, and which is more particularly described as <br />follows: <br />Lot numbered Three Hundred Forty-Eight (348) LaSalle Park 2"d Plat <br />and this property has Tax Key Number 18-4063-2326, be designated as a Residentially <br />Distressed Area under the provisions of Indiana Code 6-1.1-12.1 et seq., and South Bend <br />Municipal Code Sections 2-76 et seq., and; <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public <br />hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; <br />and <br />10 <br />
