RESOLUTION NO, 201 -.9 <br /> A RESOLUTION OF THE BOARD OF PARK COMMISSIONERS OF THE CITY OF <br /> SOUTH BEND, INDIANA TRANSFERRING OWNERSHip OF A PART OF <br /> FREDRICKSON PARK TO THE STATE OF INDIANA <br /> WHEREAS, the Board of Park Commissioners of the Civil City of South Bend <br /> (Hereinafter referred to as Park Commissioners) is authorized under T.C. 36-10-4 to administer <br /> park property for the City of South Bend; and <br /> WHEREAS, the Board of Park Commissioners is authorized to acquire and dispose of <br /> real and personal property under I.C. 36-10-4-9(c)(8); and <br /> WHEREAS, the Board of.Park Commissioners under said authority has acquired and <br /> operates the property known as Fredrickson Park, including a portion more particularly described <br /> in the attached Exhibit "A";and <br /> WHEREAS, in January 2011, the City of South Bend received a Uniform Property or <br /> Easement Acquisition Offer, from the Indiana Department of Transportation to acquire a portion <br /> of Fredrickson Park, 0.86 acres, in exchange for One Thousand Nine Hundred Dollars <br /> ($1,900.00) which it accepted in Resolution 2011-1; and <br /> WHEREAS, the City of South Bend has received from the Indiana Department of <br /> Transportation, a letter from rescinding its offer to acquire 0,86 acres and a new Uniform <br /> Property or Easement Acquisition Offer to acquire a portion of the Park described in the attached <br /> Exhibit "A" in exchange for Eight Hundred Ten Dollars ($810.00); and <br /> WHEREAS, the Board of Park Commissioners desires to accept the most recent Uniform <br /> Property or Easement Acquisition Offer from the Indiana Department of Transportation. <br /> NOW, THEREFORE BE IT RESOLVED By. <br /> THE BOARD OF PARK <br /> COMMISSIONERS OF THE CIVIL CITY OF SOUTH BEND, INDIANA that: <br /> I. The Board of Park Commissioners rescinds Resolution 2011.1• <br /> 2. The Board of Park Commissioners authorize the transfer of that rt ion of <br /> Fredrickson Park described in the attached Exhibit "A" from the Department of Public po Parks of <br /> the City of South Bend, Indiana to the State of Indiana. <br /> 3. The Park Commissioners authorize the President of the Board or the Vice- <br /> President, or in the absence of the President or Vice-President, the Executive Secretary, to attest <br /> to the Deed and to any and all other documents relating to the transfer of real estate from the City <br /> of South Bend and to effect the closing of same on the advice of legal counsel; and <br />
