(0� RESOLUTION NO. 1883 (40� A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM ST. JOSEPH COUNTY, INDIANA WHEREAS, St. Joseph County, Indiana, (hereinafter, the "County ") is the owner of the following described real property situated within the City of South Bend, St. Joseph County, Indiana: See Attached Exhibit "A" (hereinafter referred to as the Real Property); and WHEREAS, the care, custody and control of County real estate is vested in the County's Board of Commissioners pursuant to I.C. 36- 2- 3.5 -4; and WHEREAS, the County desires to transfer the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment for use in the redevelopment of the Sample -Ewing Development Area; and WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through its governing body, the South Bend Redevelopment Commission is willing to accept the transfer of the Real Property from the County; and WHEREAS, pursuant to I. C. 36- 1 -11 -8, the City, acting through the Commission and the County acting by and through the Board of Commissioners, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the South Bend Redevelopment Commission, at its meeting of April 15 , 2002 adopted its Resolution No. 1883 , approving the transfer of the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally described as follows: See Attached Exhibit "A" by the City of South Bend, Indiana to the City of South Bend, for the use and benefit of its Department of Redevelopment, shall be, and hereby is, accepted.
