Resolution No. -�0 � <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />APPROVING THE ASSIGNMENT OF THE COMMERCIAL LEASE BETWEEN THE <br />COMMISSION AND CATERING BY BILLIE, INC. <br />WHEREAS, the City of South Bend, Indiana, Department of Redevelopment acting by and <br />through the South Bend Redevelopment Commission ( "Commission ") approved a Commercial <br />Lease ( "Lease ") by and between the Commission and Catering by Billie, Inc. ( "Lessee ") on February <br />19, 1999; and <br />WHEREAS, pursuant to Paragraph 25 of the Lease, Lessee has the right to assign its rights <br />in the Lease provided that Commission has given express written consent to the assignment; and <br />WHEREAS, by the execution of an Assignment of Lease dated November , 2000 <br />( "Assignment ") Lessee has requested and Commission has consented to the assignment of the Lease <br />by Lessee to Kendall Catering, Inc. d/b /a Catering by Billie ( "Assignee "); and <br />WHEREAS, Assignee has agreed to assume the obligations of Assignor and to be bound by <br />the terms and conditions contained in the Lease and the Assignment; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT <br />COMMISSION AS FOLLOWS THAT: <br />1. The Assignment of Lease between the Commission and Lessee to Assignee shall be, <br />and hereby is, approved. <br />2. This Resolution shall be in full force and effect upon its adoption by the South Bend <br />Redevelopment Commission. <br />ADOPTED at a meeting of the South Bend Redevelopment Commission held at 1300 <br />County -City Building, 227 W.
