South Bend Redevelopment Commission
Regular Meeting —July 20, 2001
6. NEW BUSINESS (CONT.)
a. (Continued...)
MR. WATTERUD (Continued
That property can't be rented, purchased or
otherwise if it is under acquisition status. I can't
rent it. How is that going to effect me in renting
that property?
MS. GREENE: Again, I would refer you to your
own attorney. What I can say to you, is that
anyone who has an interest in the property
would receive notice prior to the Commission
actually taking an action to acquire the property.
Right now, it's simply added to a list for
potential acquisition. In the future if the
Commission does determine to actually acquire
that property, they have to send notice to the
property owner and anyone with a leasehold
interest at that point. So, there's nothing really
that's stopping you from leasing your property
at this point in time. A tenant would ultimately
have notice and as an interest there are certain
aspects of the Relocation Act that come into
play with moving people around.
MR. WATTERUD: After my phone call to
whomever I spoke with, that I mentioned, I
wasn't prepared to see what my rights were or
weren't. I don't know how comfortable I am, at
721 East Sample, with it being acquired until I
do seek some kind of legal advice. I just came
here to see what was happening across the
street. Then I noticed that I'm in [the area on
the map that is] blue.
20
