South Bend Redevelopment Commission <br />Regular Meeting— August 17, 2001 <br />6. NEW BUSINESS <br />a. Public Hearing on Resolution No. 1843 <br />amending the South Bend Central <br />Development Area Development Plan. <br />Ms. Greene entered the following items into the <br />record: 1) an original of the "Notice of Hearing <br />of the Amendment to the South Bend Central <br />Development Area Development Plan"; 2) an <br />affidavit from Carol Smith, Advertising <br />Manager of the South Bend Tribune, that the <br />Notice of Hearing was published in that daily <br />newspaper on August 3, 2001; 3) an affidavit <br />from Richard J. Andrysiak, Classified Manager <br />of the Tri- County News, that the Notice of <br />Hearing was published in that weekly <br />newspaper on August 3, 2001; 4) a copy of <br />Resolution No. 1843, which is the subject of the <br />public hearing; 5) a memo from Mr. Bob Mathia <br />that on August 3, 2001, copies of the Notice of <br />Public Hearing were sent to the affected <br />property owners and registered neighborhood <br />associations; 6) as of 10:00 a.m. EST on <br />August 17, 2001, 1 written remonstrance <br />was received from Attorney James F. Groves <br />representing Verizon Wireless, Inc., the property <br />owner at 220 and 222 East Sycamore. The <br />remonstrance was timely, is attached hereto, and <br />incorporated into the record in its entirety, as <br />Exhibit A. Verizon Wireless, in their <br />remonstrance, raised issues with respect to the <br />public purpose and public use, which is in <br />keeping with their rights under Indiana law. <br />Verizon Wireless, in their remonstrance, raised <br />an additional issue that the Legal Department <br />would like the opportunity to further review. <br />Ms. Greene quoted from the remonstrance letter: <br />4 <br />
