South Bend Redevelopment Commission <br />Regular Meeting— December 7, 2001 <br />6. NEW BUSINESS (CONT.) <br />C. South Bend Central Development Area <br />(Continued...) <br />(1) Continued... <br />Staff made the following recommendations: <br />1) Permit Ms. Kendall to stay on the <br />premises until disposition of the bids, <br />provided she signs another <br />indemnification agreement acceptable to <br />the Legal Department holding the <br />Commission harmless, and that she pay <br />for December's rent plus a minimum of <br />two months' back rent by December <br />14th. Payment is to be by certified or <br />cashiers check drawn on a local banking <br />institution or credit union. <br />2) Permit Ms. Dunlap to leave her <br />equipment on the premises until the <br />bidding process is complete and be <br />permitted to have up to four weeks to <br />auction the equipment in the event it is <br />not wanted by the entity leasing the <br />property. In return, Ms. Dunlap be <br />required to sign an indemnification <br />agreement acceptable to the Legal <br />Department holding the Commission <br />harmless in regards to the equipment. <br />Ms. Greene reminded the Commissioners that <br />they took action to terminate the lease effective <br />November 30`h and that if the Commission <br />desired to allow Ms. Kendal to remain in <br />possession of the premises beyond the <br />November 30th date, then the Commission <br />could treat the lease as a hold -over tenancy on a <br />month -to -month basis. This would have to be <br />done with the understanding that the <br />14 <br />
