Due to the impending termination of the <br />lease and the improvement in business <br />performance, the staff agreed to allow <br />Ms. Kendall to continue occupying the <br />premises until the Commission meeting <br />on December 7th. Staff stated that only <br />the Commission could permit her to stay <br />beyond December 7th and she was <br />encouraged to have an alternative plan <br />for continuing her business's operations <br />should the Commission not approve her <br />request to stay until disposition of the <br />bids is completed. <br />f. As part of the approval Ms. Kendall <br />agreed to sign an indemnification <br />agreement to hold the Commission <br />harmless during the time she occupies <br />the premises. <br />g. Ms. Kendall also agreed to complete her <br />business plan and present it to the <br />Commission at the December 7th <br />meeting. <br />h. In a conversation after the November 30 <br />meeting Ms. Kendall indicated a <br />willingness to bring her rent current if <br />she is allowed to stay until disposition of <br />the bids. <br />i. Also, subsequent to the November 30 <br />meeting it was determined that Billie <br />Dunlap is still the owner of the <br />equipment used by Ms. Kendall. <br />12 <br />
